I'm a US citizen, My wife is a Jordanian citizen and we have been married in KSA for five years. We have a 1 year old son. We sent in the I-130, they received it in September. According to process estimates we have a month left until it will start being processed.

I'm losing my job, probably May, maybe sooner. This puts us in a quandary. My wife has a visit visa, but it expires April 6th, 2017. The hypothetical is this: My wife wants to take our son and visit the US for a week, sometime this month, and during that time I lose my job here in Saudi. If she then decides to stay in the US, can we then complete the process there? She literally would be unable to return to Saudi to complete the process as we would no longer have residency. She has no residence or family in Jordan.

We don't know what else to do. I've emailed the embassy about an expedited scenario but have heard nothing back. If she doesn't stay in America, can we move the consular/embassy interview over to another country if that's our only option?

Tough situation. Sorry to hear about your job loss. She can certainly come and visit you but, unfortunately, but at some point she will have to return to complete the process. She still has to have the biometrics, medical, and interview done in her country.

If you decide to cancel the visa and do the AOS while she is here, not only is it considered fraud but it will be a huge red flag and will likely cause problems.

Why would she lose her residence if she comes and visit? Is it possible for her to stay until the process is completed? Are you with her in here country?

She is a Jordanian citizen, but has lived in Saudi her whole life.  We applied from here in Saudi Arabia.  The residency system is such that as I have a residency permit and she and my son are here as my family.  As I'm the one with the job, if I leave we all have to leave.

She should be able to continue the process in Jordan since she is a Jordian since she is a Jordian citizen. I see that she doesn't have family in Jordan. Do you have any friends that can possibly hold them over until the process is complete?

What she can do is come to the US and visit. She will likely get 6 months stay. If the is ready during that time they can go back for the interview and such.
