Hello Good day,

 

I need some help with this matter. I came to the US for school in 2013 and graduated in December 2015. I applied for OPT and work from February 2016 yo February 2017. During my OPT I found the love of my life and we got married. We got married 5 days after my OPT was expired because the marriage office did not have a date before the expiration of my OPT.

 

She is in the process of applying for me and needs clarification. 

 

Question:

 

1. Can I continue to work until she filed for me and USCIS send my new AED card?

 

2. Can I adjust status even though my OPT expired and got married? 

 

I am lost and need help with my situation!

1) You are not permitted to work without a valid work permit. If your existing EAD is expired, then it is no longer valid.

 

2) If your spouse is a US citizen, then your overstay will be ignored for AOS purposes.

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

5/1/2017: Case received by Manila (1 week embassy transfer??? Lucky~)

7/13/2017: Interview: APPROVED!!!

7/19/2017: Visa in hand

8/15/2017: POE
