how long to bring a child

Asking for my in laws. They recently became permanent residents and entered USA on feb 2nd. 

 

Can they, and if so, how long will it take for them to be able to petition for their only remaining son in Dominican Republic? Do they have to be residents for a certain period of time? How long is it usually taking for this visa to become available? 5 years?

How old is the son? Is he married?

 

How long you've been an LPR doesn't really matter. It only matters for eligibility to become naturalized, which is a requirement for certain family-based visas and/or to determine the preference category.

Same question, my son is 9. am filling the application and copying papers needed.

how long does it take for his approval?

 

also am Permanent resident, already in Queue for N-400 Interview, already did bio-metrics 5 months ago.

i know i can wait for citizenship and apply with it and i can do it with permanent resident, i would like to apply as soon as possible to have my son with me.

That would be an F2A category, which has about an 18 month wait after the I-130 is processed for your priority date to become current, then a few months for processing and visa. Total timeline is roughly 2 years.

 

Once you become a USC, he would be an immediate relative of a USC (IR-2), so there is no wait for a visa to become available. Total processing is probably about 10-12 months.

Do you advice to wait to be USC ? or can i apply for him now and update my case once i become USC?

You can convert from F2A to an immediate relative category:

Given that he is 9 years old, there shouldn't be any risk of him aging out. I wouldn't trust them to automatically convert it, so you could file the I-130 now then get your PD once it's approved. When you become a USC, you can notify USCIS/NVC and provide proof of citizenship to have them convert it. That would probably be the fastest route instead of waiting until becoming a USC to file.

Hi! The son is almost 30. He is married but estranged from his wife. He has two children. 

 

How would this work? Is he less eligible because he is married? Would the kids be able to be included in the petition also?

  No visa for married adult children until the parents become citizens.  If he divorces then there is a class ( currently but who knows about later)   and he has to stay unmarried for as long as it takes  ( figure at least 10 yeas )

Good to know. He is definitely getting a divorce soon. But you're saying even if he is divorced it can take up to 10 years for him to be able to enter USA?

As of now yes, they are very young. The mother would agree because she knows it would be a better life for the children. If it really takes 10 years then it might be different since the children would be much older.

  Currently people are being processed that applied 7 years ago.  But lines for numerically limited visa tend to get longer so expecting 10 years is not unreasonable.  Also with the new attitude towards immigration some of the family classes may get the ax and this would probably be right after sibling petitions to get the ax if it happens.

Nobody know how long it will take, 7 years is for those come up now but the line is getting longer and if there is Immigration Reform likely will not be possible at all.
