Hello,

Nice to meet you all and hope you are well,

I have a question to all.

I live in Europe right now and my girlfriend in the US.

We will like to start the K1 process soon, but next year I will go to work on Island in Africa for two years.

Can I go to do interview here? Do I need to go to US directly after received K1?

I don't know how much time it will take to receive K1 and do AOS exactly, but I will love to be on time when I will finish my two years contrat to go directly with my wife in the US?

Can I do the K1 and ask for a travel document with the I-131 for 1 year?

When one is residing lawfully in another country they can do the interview in that country. After a K1 approval you'll have 6 months to enter the US. As a K1 you apply for AOS/AP/EAD (adjustment of status/advanced parole for travel/ employment authorization document after arriving in the US and marrying within 90 days. It also takes approx. 90 days after this filing to receive AP/EAD combo card.

 

An alternative for you would be to marry first and about a year prior to your finishing you would instead apply for spousal visa (CR1), which takes around a year. With that visa you ill receive a green card upon arriving to the US (in mail shortly after), and you can travel and work from the start.

In your situation, that's what I'd do... :) but only if it fits into your plans ofc... I took the K1 route cause we had no other option... but it's been a hard wait for green card...where you can do absolutely nothing, and it seems as if you have plenty of time to plan which would make a CR1 the better option imo :)

It makes no sense to apply for a K1 now-ish knowing you'll be living and working abroad for 2 more years. The purpose of the K1 is for the non US citizen to apply, get the visa and move to the US. The I-131 is meant for specific trips, like to visit a relative, and not for a year-long stay outside the US.

 

So, you can still go the K1 route, just not now. Time it for later, given how long it takes on average from sending in the petition to getting the visa approved. Given that you have time to plan, I think the CR1 is the better option because you are granted a green card upon entry and can start working pretty much straight away, and it ends up being cheaper than K1+AOS.
