Tips on the fastest way to acquire a work visa after marrying?

Hi all,

 

I have yet to submit the I-129F form, so I may be jumping the gun here, but my boyfriend and I are trying to plan accordingly. He is worried about not having any work when he makes the move to America from the U.K. I read on nolo.com that he can submit his I-765 form with his green card application after marrying to try and speed up the process of obtaining his work visa. Does anyone know if there is validity in that? Again, I know I'm thinking way ahead but we want to be prepared. I appreciate any help possible!

Yes with the I-485, you can file for EAD and AP (I-131) at the same time. 

 

the work authorization (EAD) generally takes about 90 days to receive after submitting the AOS.

 

So you still are looking at 4 months atleast of him not working, depending on how quickly you marry after he arrives and get the paperwork for AOS sent in.

Clarification that a visa is an entry document. He will not have a work visa, he will have a K1-visa. As Ben&Zian said you will file i-765 work authorization with the adjustment of status. If he is really worried about not working. You could marry first and he can stay in the UK working while you apply for the spousal visa instead.

 

With the spousal visa he will receive the green card making him eligible to work from the day he enters.
