The only people that can decide if you can go is the embassy. I dont think lawyers can fight this or do anything special to get cspa approved.  

 

In your case, Did your parents submit documents for you? I would say you go with your parents and take all documents that you would submit to USCIS.

I think the visa available date is not I-130 approval date. The visa available date is when the priority date shows up in the visa bulletin. 

 

Still you waited for 6 years for I-130 approval so can deduct 6 years from your age at the time priority became current

They have interview on Nov 28th but he  is not included I will find out the info 

 

Maybe they had short wait for approval. Your case have 7 yrs waiting time so just need to find out when Oct 2003 became current. Just subtract waiting time from that age

Hi sir we got visa latter of date 22 jan 2018. 

My birthday- 18 jan 1990

Priority date -8 Dec 2003

Approval date -21 dec 2009

Visa date -22 jan 2018

 

Will i get visa for usa cz i m unmarried son of this file. My file is under F4 category.

  F4 is a sibling petition,  there is no aging out of a sibling petition if you are the primary beneficiary. If you are the persons child then you will be 28 years and 4 days when the visa is available.   Your petition was pending years and 14 days .   Your CSPA would be 21 years 21 days using the above dates.   

This will not be over quickly. You will not enjoy this.

Anyone  have any experience CSPA process at New Delhi embassy? 

My cousin  is under F3 one of his kid just turned  21 on  Dec 18. We know he is covered  in CSPA but his name didn't  show up on interview  letter. I called NVC today they said since  the interview  is already  scheduled  there is nothing  they can do. They said it will up to the officer  who would  interview  and decide  if he is eligible or not. 

If the kid's name is not on later he will not allowed to go in along  with parents.

All  his documents  were sent and visa fee has been paid. I sent an email to  NVC and US embassy to request   CSPA  review.  Hopefully will hear something  back soon. 

Please  share  if you are in the a similar  Boat!!!

Hello everyone,

I am really new to this immigration process so please bear with me and my lack of knowledge. I filed for F4 immigration through my sister and got the letter from the authorities stating that our priority date is march of 2006(i don't know whether this was the USCIS approval letter or not as it stated that visa numbers were not available at that time). Just a few days earlier we received an email from NVC asking us to submit our fees and documents in January 2019 (Sorry for not having the exact dates and knowhow because I'm really new to this.) 

     So my first question is that what is the uscis approval letter suppose to say and was the letter that i received back in 2006 ,mentioned above after i filed for the petition the approval letter? Secondly is my elder son who was born in December of 1993(now 25 years old) accompanying as his name is right next to mine on the ceac/gov site account that i was provided with by the NVC. Once i log in, it also has the option to pay his fees with mine. Does this mean that he is eligible for the F4 visa with me??

Most likely he is eligible since you can pay for him.  However, no one can tell you for sure since you do not know when the I-130 was approved.  Your sister should have received the approval letter. 

 

The approval letter would have said the I-130 was approved and the case would be sent to the National Visa Center (NVC).
