Hi,

June filer here, what is the adjudication expansion? Haven't heard anything about it! Have seen my timeline slipping and was wondering if there was something more to the delays!

Thanks, Em

What do you mean adjudication expansion? Also I’m wondering, I’ve submitted a service request through tier 2 to get a status on my case which they said could take up to 30 days before i get a response. Is this any different from the submit an inquiry process on the myuscis.com. Im approaching the 6 month window and they will be updating to march soon so I plan on submitting an inquiry soon if its any different from the SR process.

Looking like June filers are going to get the full brunt of this adjudication expansion.  Feel sorry for them, they hadn't a clue when they filed....  Premium processing could really help out those guys if it was available

just a term I coined that is all encompassing of the current situation we are in, it's not a term used by anyone else (that I know of), it just describes the fact that K1's have increased dramatically since 2015 - and what we used to see as a 'time frame' for the steps in this process have increased likewise.  Not that uscis will publicly state what their internal 'mile markers' are - going by their results - we can see what was once an unacceptable waiting period for uscis to adjudicate has now become acceptable.

We all did our homework before filing this.  We looked at an average of what it was taking, talked to someone, or even found VJ before we filed.  Clearly when I filed, the expected adjudication was 90 days max.  At our 90 days - some were getting approved and others still waited.  Some 120 days, and some 150.  It appears that the 150 used to be the standard (as in example, one case that was backlogged at more than 150, another case with less days was likewise approved so that with lesser days and longer days, the average was 150).  In a grander scale, this works for uscis so their quarterly report shows they are 'keeping up'.  The problem with this is it is much like 'kiting checks'- eventually as cases age and filings increase, there is no waaaaay they can keep the average 150 going.  We started seeing this in July and August.  Poor April became 120 normal before approvals (where March was 90)  This expansion of the acceptable time frame is what I am referring to.  Their little house of cards is starting to teeter - the sheer numbers of applicants are ever growing since 2015 but the resources at uscis are not prioritized in the 129F petitions.  There is speculation as to why they are not a priority, and the cash cow type of visas (those with premium processing available) are a priority.  129F's are just a very small slice of uscis pie.

Now, look at the June filers.  Considering the past performance of uscis and the February and March and some January filers still waiting, then consider where the April filers are at this point in time...........  May hasn't even been touched yet except for the expedites for military or other gov't convenience.  My inference is that June is going to feel the wait.  Sure, uscis will continue to reach under the pile and pull out a 129F that the ink isn't even dry on to 'fudge' the average number here and there to look good, but it doesn't change the fact that a June filer who has already waited 90 days, has about achieved half-time.  Just my opinion.  I hope uscis frees up staff to clear out 129F's and gets out of this hole, but that is just hope.  That's the expansion I was referring to..... They just can't keep up with demand.

As far as the 30 days uscis says to do RFE, that's standard talk for them.  You and I say 'days',  "Tomorrow" or "in a few days", but uscis works in 30 day cycles.  Everything to them is in 30 days, even if it is tomorrow, they say 'within 30 days'.

What's important to remember is that an answer is inevitable, they will answer.  It is the 'when' that is so frustrating.  Knowing when to expect something is so much better, and even though they say 6 months, we see the 4 and 5 months and expect like results.  Some are 4 months but some are 9.

.............................

Here is something rather interesting, perhaps it is the reasoning behind their waiting so long to adjudicate cases.  From a think tank on immigration, they surmise 'Committed couples endure this process'.

answering the other half of your question....

I would make contact with them every chance I could, Submitting online when it allows you to will just give them one more clue that you are after this approval and if they give you an answer, you won't be submitting them.  Less work to give you an answer than to keep you in waiting :) I think they are the same thing, online or thru tier2 but it's 2 fold if you can do both.

Hey All!
So, i had an awful and busy Friday with a side of meatballs...
I woke up to a message from my F who told me that he had decided to reread the instructions from the embassy before calling the schedule the interview just to make sure he had everything. He discovered that my ORIGINAL divorce decree was something that he needed to have. When i read this, I woke up REAL fast and not in a groggy state anymore. I called him immediately!! He said called the embassy to inquire about this and the lady asked him if he had scheduled his interview yet and he replied no. She said no problem, she has time to mail them to you then. LIKE UGH!!! LIKE A SERIOUSLY ####### MOMENT!!! And keep in mind I had already sent my signed papers by DHL Tues and he got them on Thur!!!
So, I immediately start freaking out and he is like, it's ok honey, you just need to go and get them and you can send them. I called work and asked if they minded if I was late to work and they said it was fine after I explained why. It took me 3 hours to get to the courthouse, then to get to the DHL place, then to get to my work due to an accident and construction and then just rush hour traffic and none of the places were remotely close to each other and all was completely out of my way. Then about 2 hours in to my shift one of the managers pulled me into the office, hands me paperwork and asks me if I remember our conversation after I had gotten turned down for one of the full time jobs that I had applied for and I was like yes and he was like ok, do you have any questions for me before we get started? And I'm like is this an interview? and he is like yes... and I'm like OMG I did not know!!! and start panicking about my day and how I didn't even have time to shower blah blah blah and he was like.. it's ok... long story short after the interview, he gave me the paper work for the job offer on a different full time position that was available!
And then yesterday, after working till 11pm Fri night, I had to be back to work at 8am so of course I did not get much sleep, anyhow, I came home and crashed and got close to 12 hours of sleep, but fell asleep with the AC on so now my throat doesn't feel that great, but I feel great that I got some good sleep.
Oh, and if my F gets the documents on Tues in time, before the embassy closes, he is gonna still try to get his medical and interview done by the end of the week!

What a day!  Congrats on the new job :D

Thank you =) It really was quite a day.. lately I feel like all my days are busy busy busy and as I have said before, I know all of us here can relate to this lol

In regards to the new job...
My immediate manager would not put me in to a full time position for the job I have been doing for the last 8 years and I have strong suspicions it is because of my age since he has only been hiring only 18 and 19 year old girls... not saying there is something wrong with that, just that would be discrimination. And even worse, he has recently hired 3 of them on full time and they had only been with the company for a few months and I have been there for 8 years now and never written up and always show up and never call out unless something is absolutely wrong. On the other hand, they call out all the time and call me in to cover their shifts when they do call out... its just such BS so I am really glad that I will no longer be under him anymore. There was this one girl that he would hang all over and follow her around and she got tired of it and quit. Now he is doing it to another girl and she calls out at least once a week and he created a new position just for her. Oh, and a coworker of mine who is the same age as me, can't get a full time job either and she has been there for 9.5 years.
Thoughts?

wow, That's really bad.  It's a sticky situation.

From what I've seen, those kind of bosses eventually get their hand caught in the cookie jar.

I'd consider EEO, or US Wage but wow, that's like using big guns.   Maybe just wait and see and look for another job in the meantime.

Yeah, I have tried that too... I have an associates and was working towards bachelors when I took break from school to get a FT job so it would look better going through this process... never got a single call for an interview or anything. I even have previous work experience in the medical field... it just really sucks =/

I work in medicine.  With declining reimbursements and greater regulations plus our universal healthcare - the future of healthcare is not very bright.  However there are some gems left.  What is your specialty? Nrsg? OT? PT? UC? MT?

Right, I agree USCIS is actively attempting to extend the wait process right now to reduce the legal immigration numbers and make trumps base happy.

In regards to the chart you posted above, March is getting awfully close to the 82 percent approval mark now. How long does does it take before USCIS marks someone a rejection? They have no valid reason to reject me at this point but I’m just wondering how they typically handle it in case they are waiting to send out the rejection and I happen to be in the pile. Do they typically wait to send all the rejection notices after 6 months have passed?

I wish I could say "no more paperwork until the AOS" but I'll still have to deal with some local red tape before leaving :) Anyway, I feel so relieved now, looking at the actual visas :jest:
