Which Consulate is involved?

Hi

Sorry it took me so long to get back to your topic. You posted here and in the megathread "reporting fraud to USCIS". I figured Id respond to your last comment in this thread since its case specific.

Just to recap- I asked if you were certain it was an Embassy interview where he filled out his prior B application and not a 'service'. You responded you know it was done at the Embassy because 'someone came to your house to talk to him about it' (paraphrased).

Who came to the house? Someone from ICE or DHS? Honestly Ive never heard of them doing a check up on someone on a B. Was he on a student before and was switching to a B? It just sounds weird- Unless it was a legit gov agency talking to him that was overheard (which is odd with out an explanation) then theres no way to know for 100% that it was on the Embassy application.

Moving on, there was a lot of talk about Facebook..... Facebook is a silly thing. They (USCIS) use it as a double edged sword. If THEY look into facebook and see questionable stuff then they are all like 'oh facebook is proof so you fail'. But if YOU present facebook stuff as evidence for a benefit (AOS or ROC or even citizenship based on marriage) then they are all like 'Heck no! facebook isnt proof of anything, you can generate anything and post it'.

If you think about it, its really very smart of them to have this policy. Because if people dont think USCIS is going to look at their facebook- they will post all kinds of the truth (or the truth they want to portray). If  the USCIS looks and finds bad things its like- well, it has to be true or somewhat true because they either didnt think we would look or they are just stupid- but very few are that stupid to make 'negative' quality facebook material full well knowing the USCIS is looking into them,

When its a person showing it to them willingly- its either someone who wants to look good, or someone trying to show them something bad. Either one can be created with one of those purposes in mind. So its not very credible when they get it handed to them. They seem to want to find it on their own to give it credit.

Finally there was a point about him having children and not having them disclosed on the K forms. This can be proof of fraud if USCIS believes you honestly didnt know- but somewhere in the forums- I saw it while browsing the last week or two; there is a posting about a parent (from PI I believe) who didnt list one of her kids on the K and now wants to bring them... It can be done. The thread actually links to a thread from year+ ago where someone else asked and did the same thing.  So this two is an odd issue and can fall either way.

I also just want to point out (and I should really do it on the other thread) but just because the Officer at Infopass wouldnt take your stuff or pass them to the Fraud Officer- well,,, dont read too much into it. Theres a bunch of reasons why that couldve happened besides them snubbing you. Maybe the fraud guy was out sick, or in a meeting or something. The Officer maybe cant take papers on his/her behalf. Maybe the Officer offered you their unsolicited opinion that you have nothing so you would leave. Some places have guard dog staff like that. Perhaps if you were more insistent- or asked for the Fraud Officer specifically- and if told no, then a reason why obtained.

You asked what else you could do-- Its hard to say with out knowing more specifics. But based on what you posted he doesnt have enough for ROC if thats all he has and he doesnt claim abuse (by you) hardship for not having more. Very few people are denied ROC- but he is looking like he is going to be one of them.
