I don't know if age difference is a major red flag for costa rica.... is he older or are you older? How large of age gap?

Also just because you marry does not guarantee an approval for a visa. CR-1(spousal visa) can also be denied like a K-1.

You need to make sure you can prove genuine relationship.

Also, K-3's are rarely used or approved anymore... CR-1 is the way to go... it can take about 12 months generally.

You can ask for an expedite; but there are limited reasons why they would actually approve it for normal circumstances; but you can try.

It generally is not used that is why.

Him being older definately does not seem like much of an issue honestly..... least not in a lot of cultures.

Also don't try to get a tourist visa to come to the US to stay.. that is visa fraud and can result in a lot of issues for you. Do things the right and legal way always and be honest on all forms.

K-1 can take 5-7 months about. It is typically the fastest route.

Review the guides here:

http://www.visajourney.com/content/i130guide1

And discuss with your fiance about which route you both would prefer to take. Choice is solely between you two to make.

ty I really Appreciate it  the problem is he is 30 years older I feel scared because the k1 may be denied due to r the age difference   Yeah he wants to try the fastest way ... but I think the right will be the    ir30  . I requested a visa  the b1 on December even I was not married  was denied because I did not show a strong tie  that I will come back . I will be married in 18 days is possible to request a tourism visa to go to visit my husband ????? or only because  I am married they will denied a tourism visa to go sometimes   of course in 22 days he will send the form to uscis after we get married

1) Being 30 years old will likely be a flag. It does NOT mean a denial. You just need to provide enough proof of a real relationship (K-1) or marriage (CR-1). Whichevce2r route you choose, provide a lot of evidence upfront when you file, then more evidence later. How many times have you met in person? How long?

2) Unfortunately, there is a very small likelihood of getting a tourist visa in your circumstance. A previous denial due to a lack of ties and then having a fiance, or worse a spouse, in the US shows reasons to not leave the US. A tourist visa is only to visit, not stay. The latter would be visa fraud.

If you are marrying, then you must do the CR-1 (I-130 form). You must remain unmarried to be eligible for the K-1, so that's not possible in your case.

Also, as noted above, K3 is obsolete. Only a small handful are approved each year...the rest turn into a CR-1. It's a waste of money and at best saves a couple months.
