10 year green card coming up

Well I hope your kidding but somehow I think you're not.  We will be submitting our paperwork in June this year.

 

So you're say I should begin assembling 24 months of joint bank statements, electric, gas, cell statements, survivor benefit statements, car loan and insurance premium statements, etc.?

 

Seems more daunting than our initial CR1 data submission process.  I was planning on just sending in a few of each showing both our names but not 2 years worth. 

 

And the current turnaround is 6 months +?

Yes that is what I am saying.  USCIS will want to see document evidence dating back two years.  Ask me how I know?  Dare ya! :lol:

My guess: You didn't and got a RFE delaying the issuance by more than 4 additional months?

We just finished ROC - One Year, Two months and Sixteen days later it was approved. Yes two years of everything and we are not :jest:

So you got the 10 year card in hand AFTER the date @ 3 years you could begin the citizenship application process?  What a racket.  And I thought the path would be smoother after the family hit the POE.  Guess I was sadly mistaken.

Did your wife have to refrain from taking any trips out of the country (to visit family etc.) for the whole time you were waiting?  Since the 2 year GC is expired, she had no evidence that would allow her back in the country if she left, right?

Indeed!  Is the 10-year card required to apply for citizenship?  If not, might as well just go ahead and apply for citizenship even without waiting for the AOS to be approved!

As I understand it, the ROC can be applied for within 90 days of the 2 year anniversary of the petitioner entering the US.  Not sure what the repercussions are if you wait until after the 2 year anniversary.

 

And again, as I understand it, the petitioner can apply for citizenship, after 3 years of US Residence.  Each of these filings come with associated fee requirements.  Not sure what the status is of a resident, 2 year green card holder, that lets the card lapse, and jump directly to citizenship application.  Can't believe there is some illegality during that 1 year timeframe.  Hopefully not enough to be swept up in an ICE raid :).

She did not have a need to travel so it was never an issue. If you apply when you are first eligible then when your case is excepted, you get a 1 year extension. You take the letter, your passport and your GC and you can travel with no worries. You'll get back in because GC holders are not an issue and the Philippines is not a country that is on the travel ban list. Your stretching based on what you hear in the newspapers, and the writers are full of fertilizer.

We didn't provide two complete years of evidence, and we got the RFE.. but even with that "delay" my wife still had her approval in a few days over 3 months, and her new GC in under 4 months.

 

USCIS wants to see TWO YEARS of document evidence...  so now I tell everyone.. make sure to give it to them! :lol:

Sadly... YES.   You can not start the N-400 process until the new GC has been issued.   Sucks.

 

Get your green card, turn around file the N-400, then they take your GC away from you again... :lol:

The bold is correct except you still have to be married.  Otherwise, you have to wait 5 years.  I would not recommend anyone not applying for ROC before the deadline.  They give these time frames for a reason.  You will be taking the chance of being out of status and possible be removed.  Once you send in your ROC packet, you will receive a 1 year extension letter that allows you to continue to work and travel.  If your ROC has not been completed within a year (happens frequently especially with VT) , you can get another extension via a stamp in your passport through infopass.
