hi, my wifes green card will expire on june 7th, 2007. i send the i-751 and all the supporting docs on the 20th of feb, i got a rejection letter, stating i filed the form too early, need to file within 90 days of the green card expiration.

i resent the documet on mach 14th, 2007, got a rejection letter again, stating "the service is unable to process the petition as submitted. it appears that the form i-751 is not necessary at this time."

any thoughts gusy

any help or suggestions will be very much appreciated.

I'm a little confused with what you write and your timeline... according to your timeline you didn't have your AOS approved in 2006, so your 2 year card shouldn't expire until at least 2008.... could it be you're a year too early?

edit to add: "2/10/2006 - I-485 transfered to csc, will take between 270-300 days...." from your signature timeline

How can your green card expire in June when your timeline shows applying for AOS July 05?

Also your profile still shows filed for K-1, since you are married now, and are filing to lift conditions, how about updating it to show lifting conditions?

timeline has not been updated, my wife came to us in june 07-05. got the conditional green card sometime in jan 06, has an expiration of june 07-2007. i will update my timeline, in the mean time if you guys can help me out with my question i would greatly appreciate it.

Recheck the date on her greencard.

She may have arrived in June 05 but on K1. You married and then adjusted status and didn't receive her card until 2/10/2006. If this is all true, she should be filing to remove conditions some time in July 2008 by my calculations.

the expiration of the conditional green card is two years from the day she came to US, which was 07/07/2005. i am 100% sure that her green cards expires on 07/07/2007. i don't understand why i have to file for i-90. any thoughts...

That doesn't make any sense! The conditional green card expire 2 years after its issue date. For example, I came to the US under a K1 as well, in June 2004. I only got my conditionnal green card in Sept. 2005, so my card expires in Sept. 2007. If your wife got her card in Oct. '06, then her green card doesn't expire until Oct. '08. You seriously need to double check her actual green card.

hi all, i did, actually the copy of the green card is in front of me, the expiration is 06/07/2007. however, i just noticiced on the top of her green card it says,

"PERMANENT RESIDENT CARD".... Does this imply, she never got a conditional green card....

What does it say on your green card..... Again, she came in 06/07/2005 through k1 visa....

Ok this makes absolutely no sense... the resident since date on the GC would not be the same date that she entered the US unless she entered on an Immigrant Visa (CR-1). If she entered the US on a K visa, her resident since date would be much later when her AOS was approved.

could it be possible you have been issued a greencard with an incorrect expiry date?! when was her permanent residency status approved?

Conditional greencards always expire excactly 2 years after approval of permanent residency status.

Hi

My two year greencard also has Permanent Res. Card. I filed my petition within 90 days of expiration date.

This is a conditional STATUS, despite of

fact that you don't see the word CONDITIONAL on the card.

You need to file to remove conditions within 90 days of the exact day of expiration that is in the front of the card ( not from the day she stepped her foot in the US)

If the card expires on 06/07/2007, in JUNE, that means you can fill within 90 days of this day...

90 days....get a calendar, and do the math.

If you try to send a petition before 90 days, they will send it back to you....

If you fail to file the petition, or if you file it AFTER THE EXPIRATION DATE, you will probably get denied..

I'm not a lawyer, but if you find the process too confusing, you should consult A lawyer....

They all say Permanent Resident Card. .. there is no "conditional" on them.

I'm afraid it sounds as if a mistake was made with the date when they issued your wife's card. The expiry date should be two years from the date it was issued, not the date she arrived over here on a K1. It would be a good idea to make an Infopass appointment and get definite answers.

you can tell what status the card has if you look at "category": CF1 means conditional greencard

Anyway, when was your AOS approved?, your card seems to be issued with incorrect dates. You should definetely make an infopass appointment and see what they have to say. I believe if USCIS issues an incorrect card and the error is USCIS error, then you won't have to pay anything to get a new, corrected card issued.

90 days from July 6, 2007 is April 7, 2007.. I bet if you sent it in now, it wouldn't be rejected...
