Sorry if you said already this but just one question... Are you applying for a K1 (fiancee) visa or a Spouse Visa? 

If you do K1 visa, do not dare to take your fiancee out of the US territory without an Advance Parole (combo card combined with EAD). Because she wont be admitted back when she returns to US. Right now we are living challenging times with all the new things going on in the immigration dept. You guys can travel any place in US.

HIs timeline indicates k-1 visa.  As far as all the "new" things going on in the immigration dept, I can't name one that affects K-1 or CR-1 visas.  But I digress.

This really shows how people should always read the comparison of the various visa types in full before hastily sending off the I-129F in the mail. I'm sure a lot of people only read the part that the K-1 is faster than a CR-1 and overlook all the disadvantages. Too late for the OP now unless they abandon the current petition and file a spousal petition after marriage but hopefully will serve as a reminder to new lurkers. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Yep. That and can't work until 3-4 months after the wedding. That is basically the major trade-off between the speed of the K1 and the convenience of the CR1. Essentially, when you choose between the two (if you've got the choice, which not everyone has) you're choosing where you want to wait for your green card-- in the US (K1) or out (CR1). If you choose to wait for it in the US, you've got to deal with living in the US without LPR status which means no work, no foreign travel.

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

However, there's a ton of great honeymoon destinations in the US, especially if your fiance hasn't really been here before. Save the Mexico visit for your anniversary trip!

 

But DO NOT LEAVE the country before getting the Advanced Parole document! Glad you asked before booking because it would have been a problem.

You can actually travel to Puerto Rico without ap after the wedding because it part of US territory?

I am not sure about "no work". I thought you can get temporary card while waiting for green card to go ahead find job?

Yes, and I am sure about "no work" (been there, done that, bought the t-shirt). You apply for temporary work authorization (along with advance parole) when you apply for AOS. It is actually a combo card, if you get both. That card takes 3-4 months after you apply (after your marriage). So, in the first 3-4 months after you're married and apply for AOS (which can be 6 months or more after she arrives, depending on how quickly you get married and then apply for AOS), she can't work or travel. This is a very serious trade-off and is one of the main reasons people who have the choice choose CR1.

 

Now, it IS possible for her to apply for work papers the moment she lands. But, those work papers will expire as soon as her 90 days end. And guess what? It takes 3 or more months (90+ days) for those work papers to arrive. So, if you do this, you've spent $410 filing fee on something that is likely to arrive already expired.

yes. You only need to show your drivers' license (as a USC). People have been getting more nervous about it, but we had a direct flight and zero problems. I would make sure your fiances i-94 is still valid (authorized stay until at least a few weeks from when you go) and that you print out a copy of the i-94 showing their legal entry. And if the flight happens to get diverted to a non-US territory, you can't leave the airport

No. You can't work either. Not until you recieve you work authorization which, as mentioned, can take up to 3 - 4 months after you marry/file AOS. Take a peak at the guides and do some search here on the topic get more details of what you can and can't do. In some cases the immigrant can't even get their drivers license until after they recieved their work authorization.

I mean, technically, you are right. With your Green Card application, you file the application for an Employment Authorization Document (i-765), which is a temporary card that allows you to work while waiting for your green card. The problem is that it won't arrive until about 3 months after you submit your package. Before you get the EAD, you can't work.

Many people have had to forego honeymoons outside of the US due to being here on a K1 visa. This is really not that big of a deal, especially when there is plenty of places within the US to honeymoon. You can always do an international trip after your fiance gets their greencard. Personally, I wouldn't take the chance of even traveling to a US Territory without AP because there's still to much of a risk of your fiance not being let back into the US. Why risk having your fiance get stuck outside of the country for a trip that can be taken at a later date.
