Overstayed ESTA visa - AOS question.

Not sure if I'm in the right forum here but a couple of questions regarding an overstayed visa and change of status, etc.

 

I came over to Los Angeles in early 2014 on a regular I-94 ESTA tourist visa from United Kingdom and overstayed. 2017 and I'm still here, and getting married next month to my fiance, a US citizen. After we're married, we plan to apply for change of status to permanent resident. We have one son, born here last November and identical twin boys due this June.

 

My two questions are, how long is this process usually, and I assume it will take longer given I overstayed, rather than simply coming over and marrying whilst my tourist visa was valid and I wasn't overstaying, and secondly, once we apply for change of status, how long before I will be able to travel in and out of the country again?

Nobody can tell you how long it will take it depends on a lot of things amount others how long a wait for an interview at your local office.

 

Your case won't take longer just because you overstayed a lot do that and are still processed fast.

Your overstay should not impact the length of time the process should take, which will likely be in the 3 to 6 months range.
