Not sure if I'm in the right forum here but a couple of questions regarding an overstayed visa and change of status, etc.

 

I came over to Los Angeles in early 2014 on a regular I-94 tourist visa from United Kingdom and overstayed. 2017 and I'm still here, and getting married next month to my fiance, a US citizen. After we're married, we plan to apply for change of status to permanent resident. We have one son, born here last November and identical twin boys due this June.

 

My two questions are, how long is this process usually, and I assume it will take longer given I overstayed, rather than simply coming over and marrying whilst my tourist visa was valid and I wasn't overstaying, and secondly, once we apply for change of status, how long before I will be able to travel in and out of the country again?

The process for adjusting status is the same regardless if you overstayed or not. Processing times for your local field office i-485 can be found here. If it is Los Angeles field office, as of December 31st they were processing June 21st applications. This can change though. A year is not uncommon at many field offices.

According to visajourney processing times the average time between i-485 received date and receival of the GC for the LA office over the last 6 months was roughly 245 days.
