Hi All,

 

I filed my petition of removal of condition on permanent residency in Oct 2015, based on marriage to USC, received a RFE back in May 2016 and responded within timely manner. 

 

I have not heard anything ever since.

 

The last time I called the tier 2 officer informed me that my case has been transferred to my field office in Memphis TN, and I should expect to hear something within 180 days. 

 

Another 180 days, are you kidding?

 

My current job requires me to hold a state regulated license, which the association is having a hard time to recognize my temporary status proof. (BTW, it is literally a stamp and hand written by IMO something like " this person's case is still pending", since my original NOA letter has expired), I am applying for school at the same time and worry that my student loan will not be approved, meanwhile my husband is going on a deployment soon (he is active duty). 

 

I have filed several service requests stating my situation, have scheduled info pass for next week to go in (which I don't expect will help with anything).

 

With all these being said, I am very stressed and not sure what else I can do. I truly hope everyone else is having a less miserable waiting time than me.

Hi Thank you for the response.

 

I am currently looking into ombudsman service, from what I have learnt so far they will only assist you to inquire the detailed status of your case, is that correct?

 

I guess I had too much confidence in UCSIC so I chose to wait it out.

 

I contacted my congressman during my initial adjustment of status however they were not very helpful, so I have not reached out to them yet either.

If you have been married more then 3 years and had your GC for 3 years then file for citizenship (if you wish too of course) that should force them to take action on the ROC.

Thank you, I have considered that approach as well, however it will take another 6 - 8 month. 

 

What I am really needing to know right now is can the stamp and hand written statement by IMO on my passport truly serve as a valid proof for my status and employment authorization.. and what would my status be when an employer use e-verify?

The stamp you get is valid! You can still work and travel and everything. under e-verify it should still be legal permanent resident.

Unfortunately not all the field offices prioritize ROC interviews over the AOS and N400 interviews. Even with the help of congressperson or ombudsman, field office could just say your file is in line for a I751 interview and they cannot provide a specific timeframe when it would be scheduled. Regardless I would still get help from the congressperson first. They are usually faster than ombudsman's office in getting answers. Let's see what they say.

Yes. Whether a layperson understands what exactly the stamp means, in the absence of a physical GC is another matter.  The majority of US citizens by birth have no understanding of the whole status saga.

E-verify will show you as a LPR, I presume until the expiry of the stamp, as when you get it, they update their systems to reflect it.

 

 

[EDIT - seriously, this board censors the three letter abbreviation of a W followed by T then F ? :rolleyes: ]

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Thank you for your guys' insight, it makes me feel somewhat relieved..

 

I will involve my local congressman after the visit to field office next week, I'm hoping I can hear some constructive update rather than "you just have to wait". 

 

I completely agree average Americans do not understand the whole process of immigration and it is causing a lot of unnecessary trouble..

If it makes you feel any better I have been waiting longer then you hah August 2015 filer.Coming onto 19 months wait ?.Called multiple times,submitted over 3 e-requests,went to two infopass appoitments,spoke with senator of my state his office made an inqury about my case and still nothing.

 

They just tell me these cases are not a priority,and that they have seen cases take up to 3 years.Absolutly insane.

 

Yea i also got the i-551 handwritten with stamp looks like I wrote it lol

08/11/2015- Received I-751 notice extending my conditional resident status for one year

09/10/2015- Took Biometrics

03/10/2016- Called USCIS to ask about my case,they said no updates and I am within normal processing time

08/23/2016- Called again to ask,they still said within normal processing time,no updates

10/11/2016- Date my conditional green card expired(the one year extension),called again they said schedule InfoPass

11/6/2016- Went to InfoPass and got I-551 stamp extending my permanent residency for 1 year, was also told my case is now at local office

12/15/2016- Still waiting......................

Good morning,

 

Just a quick update on my case :

Received a mail from USCIS yesterday notifying me that my case is scheduled for an interview on Apr 11th.

 

I was hoping to get an approval letter just like many people here without interview, but I guess I'm just so "special".

 

Well it's better than no update I suppose, now I just have to gather all the information that I have sent them...

 

Also FYI, I called USCIS yesterday morning to inquire my case details, and tier 2 officer did not even mention that I'm scheduled for an interview and the letter was sent out 3 days ago - they really need to do a better job on consolidating information in their system.

I think interview is better then nothing.After the interview you will get it within the month.Good luck.

The only document I'm aware of I751 interview waiting times is this one from October 2015. https://www.uscis.gov/sites/default/files/USCIS/Outreach/Notes from Previous Engagements/PED-Field_Ops_Agenda_October_2015_Cleared.pdf

Page 5-6 lists waiting times for I751 interviews for certain field offices.Unfortunately Baltimore is not listed. However, as you can see it can take from a few weeks to almost 2 years to schedule I751 interviews once the field offices get them. I hope Baltimore is not among the slower ones.

 

Have you filed for N400? That would at least force them do a joint I751-N400 interview.
