Hi everyone,

 

I've been lurking for quite some time and I've actually gotten my K-1 packet together to send off for my fiance by reading all the posts on VisaJourney. I'm just a little stumped and tried looking around the forums for answers but couldn't find exactly what I was needing. I'm a USC petitioning for a Cuban Citizen, however, I'm just a bit confused on how this will all work. His job sent him to Argentina as a student for 6 months - 1 year for more training. Am I still able to send in my K-1 petition to Havana? And if so, will he just need to go to Cuba a couple months before the interview to receive all the necessary docs and do the medical exam?

 

Do I need to fill out another G325A form? Since right now he's living in Argentina? Or, can I just send it in with his Cuban information and not say anything about him being in Argentina since he's there as a student and will only be there temporarily?

 

I don't want to wait, but should I wait until he's back in Cuba to send everything off? I've already gotten his signatures on all the forms and the forms have a date of Feb 2017 so I'm not sure if they expire after some time. Would it still be valid if I sent them at the end of the year or beginning of next year with Feb 2017 dates?

 

I want to do this right because I'm desperately wanting him to be in the US with me ASAP.

6 months-1 year means he might be able to finish his medical and interview in Argentina since he is residing there.

Yes, I know it goes to a TX lockbox, but once it's approved it would go to Havana. Or should I update the I-129F and state that he'll apply for a visa abroad at the American embassy or consulate in Argentina? so it can be sent there after the NOA2?

 

Also, he doesn't have any of the forms with him that he would need such as his birth certificate, letter of single status or his police records from Cuba. Would he still need all of those things if he does his medical and interview in another country?

Yes he would still need all of those things. Also if he lives in Argentina for more then 6 months he will also need to have a police certificate from there. 

 

It's all up t you guys if you want him to fly home for the medical/interview or if he will do it in Argentina I just listed that as an option since he will be legally residing there.

Since he is in Argentina, it would be better if he completes everything there. There would be so much of a confusion if he goes from Argentina to Cuba then back to Argentina again. As an example, I am originally from the Philippines but since I am working in United Arab Emirates, we processed the visa from there. I just went back home last year to get some documents I would be needing for the interview but everything was done in the UAE, even the medical. I was just in UAE temporarily too.

 

If he is in Argentina for 6 months to 1yr, I suggest you do it now and send the packet and have him do everything in Argentina. Before his 1yr is up, you should be getting the results of the petition. Ours just took 4 months from filing to approval.
