interview denied because the lady was tired and missunderstood my custody dicree

Help. I can hardly even type. because my fiancee's interview was 2 hours ago. the white lady at the Lagos Embassy flatly told my nigerian fiancee that I am a liar and I lied to him about my marital status and they refused to take his passport and told him he was denied and gave him every document back except my tax returns and gave him a  paper that says recommend revocation. he argued with the lady and security had to walk him out. I don't know what to do. we've been together 3 and a half years and my whole world has just crashed down and I prayed everyday. I don't understand.

 

 

some history.   I have three kids. I was with thier biological father for 17 years and he was abusive. I left him in 2013 and took full custody of my children because he was a threat and he was unfit.  I have never married him and I live in the state of Alaska which has absolutelly no law making common law marriage existent in the United states. 

 

the lady asked him the normal questions and everything went well until she looked at my custody decree for my kids. because I took custody away from thier unfit abusive father so I could travel outside with my kids without thier biological father's permission and was easily granted. I never married him.

 

I sent with my fiance my last three years tax returns showing head of household 3 dependants.  and the custody decree. but there is NOTHING that mentions divorce because there never was one without a marriage. I do have all 15 years of my taxes stating head of household un married with dependants but I never thought they would question me so I didn't send those in.

 

my fiancee said the grumpy while lady talked to like 40 people before him and she was so carelessly looking at my custody decree and instantly made the assumption that I was married. and turned to my fiancee and actually tried to convince him I was a flat out liar to my own fiancee and said I got a divorce in 2015. which is the same year I got custody of my kids. so she misinterpreted the decree out of laziness. 

 

please i hope someone can tell me how to fix this before that revocation is finalized by her supervisor. I never recieved any RFE about my background or marital status before the interviewer made her decision my petition was solid!!!!! I can't stop crying.

Pretty sure that your only option now will be getting married in Nigeria and applying for the spouse visa, CR1. Nigerian embassy is known to be difficult for K1.

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

does anyone think I can just send in my 15 years of tax returns and they can change thier decision with that proof? please is there anything I can do promptly?

No you can't just send that in. Your case is closed now. You can do as I wrote above.

I am not sure if I agree. Just because I am upset I am still somewhat knowledgeable of this process with the research I have done. I believe there is an appeal process and I could also get an attorney if need be. It's a very obvious oversight. my fiancee watched her carelessly read the documents while yawning   I legally have never been married and I do have proof of that.  Please if someone who has ever been through the more difficult process please let me know if I still have any chance to turn this around. my whole life and savings should not be based and decided upon a tired interviewer that did not properly examine my documents. they have supervisors at the embassy that need to approve of her decision.

If there is any chance they will reopen your case and allow for any evidence. You will need more then just tax return showing your were single. You lived with your ex for 17 years, you need proof Alaska does not have common law marriage. You're going to to need to get the law and proof it. Since they think you're married I would not even go the spousal visa route till you can show them you were never married with the actual law and probably from a lawyer. 

 

By sending the custody papers you gave them pause, many states unmarried mothers have sole custody.

There is no appeal the K1 will die off and no taxes are not proof you were never married. Many ppl file them wrong either by mistake or on purpose.

Your documents were looked at before the interview took place. When your fiance was at the window she was just going over them again with him.

  Lagos is known for crazy CO's .  You have to just get by this.  They will delay and hinder a review and the current petition is dead.   Have a good cry and decide what is next. Lagos will hold the K1 until it expires and it will be closed on return.  Think to the future.  We survived a first round denial.  You just have to go in better prepared.  Remember to cover the issues of this denial in the next petition

This will not be over quickly. You will not enjoy this.

You can't appeal a K-1. you can ask for them to re-open the case but it has to be before they send it back and sending your tax returns is not enough anyone can just state on those they are not married when they file.

I don't know if the embassy will look at anything additional at this point but you can try, of course it was better if it was done before the interview.

 

Try to type a very clear explanation letter stating you were never married, no common law marriage in your state (attach the copy of the law, you can get webpage online), describe short but all clear and send ASAP to the embassy by email as well to your fiance, later you can also try to send the same through your senator or congressman. Better if you notarize your signature on the letter

I will try to write a letter pleading that they review our case and reopen it. tjank you for your advice. really this is my last string of hope it seems. I know my documents are strong. we frontloaded that is why I put the custody decree in there. how could being more truthful get me into this mess. im new to this whole thing so i didnt know the details what they want except the truth. The lady actually told my fiancee I was scamming him in her exact words and that i lied and he should realize that I was a fraud.  I have absolutelly nothing to gain. my fiancee is so dirt poor and me and my children have termoiling broken hearts now.  I just need to think for a while. I cant believe they can get away with treating hard working paying americans like this. I followed all the rules as they required. i begged my fiancee to be with me for 2 years before he agreed he never cared to come to america initially. he said there were 40 interviews and she was the only lady doing them all today. and she denied 4 people. with us being one of them. he believes she deliberately denied us purposely because she was tending to someone else and the beginning of interview went so well through all the questions. until she made a quick assumption without properly examine my documents.  there was absolutelly nothing that would have represented a divorce. she said she believed I was married before and divorced 3 years ago. where she got that info was her own ignorance. I'm livid at the Lagos Embassy.

You always need to put on top an explanation letter if it's not easy to understand your documents or they are too many and too long to read, short precise explanation letter on top helps a lot
