My paperwork for AOS just got received at the P.O BOX this monday (no notification yet just know itwas delivered). And I just now realized I forgot the $85 biometrics fee. I got everything done perfectly, BUT I FORGOT THE BIOMETRICS FEE!! And I am applying from a VWP

 

I feel so stupid! I'm literally having a panic attack right now I don't know what to do... Should I send the money order for the biometrics by itself? Should I call and get my paperwork withdrawed? I dont know what to do, please help :(((

They might just send you a biometrics appointment letter where they also explain how to pay for it. The absolute worst thing that can happen is that they reject your applications and send the package back to you with a letter explaining how to resubmit it. So it's not a huge deal.

Am I still able to do that under the VWP in the case of having to resubmit??? I Think i have read somewhere that you cant apply a second time or something like that... this is why im freaking out... :(

I think you should be fine.  Wait it out to see if they send a rejection. Which is the worst case scenario. It just means they'll ask you to resubmit with the correct fees or as previously stated to submit payment for biometrics separately. 

 

Just adds to the processing time, which sucks, but not an insurmountable error.  I've made mistakes with filings too, so I appreciate how you feel.  I was SO mad at myself and felt sick to my stomach.  

 

I met a girl the other day who came to the US on VWP and then filed for AOS.  She had to frontload the application to show it wasn't an attempt to circumvent the process.  If you do get your application returned for resubmission just ensure there's ample proof in there to help ensure it is not denied on grounds of suspected fraud :)

Yes I'm hoping I just have to submit the payment seperately... Thats exactly how I feel, sick to my stomatch. Argh just doing all the paperwork and making sure everything was right to make such a pitiful mistake...

What does frontloading mean if you don't mind me asking?

Submitting documentation/evidence in excess of what is required. 

 

She was worried they would reject the petition outright bc she entered under VWP and then filed the 130 for spousal visa and 485 for AOS, but she didn't have intentions of staying when she came.  To help her case she submitted a copy of the letter she sent to her employer resigning bc she left the country and the subsequent record of employment showing the termination date, plus screenshots of Facebook announcements and some written statements from people she was with etc.  It's not adjudicated yet but I thought that was a good idea on her part when she told me.  

 

Frontloading would also reduce the likelihood of an RFE, though still possible as it is dependant on the individual agent who works your file.

It's only if you receive a denial that you might have a very hard time to file again if you arrived on VWP. Your case is many, many months away from approval/denial at this point. A rejection counts for nothing as they didn't even accept it and therefore never entered it in their system. So you're safe for now.

I forgot to pay the biometrics fee too. After a month, I received the whole package back. I posted everything with the new checks about 2 weeks ago and they were cashed on 2 days ago. 

It sucks but all you can do is wait. Good luck.

Do you have to pay for everything again for this mistake? Or did they return your original checks??? I'm more worried about this than anything because I have no more money to give.

The application will be rejected for "incorrect fee" so they return everything including the checks. So no you wont be paying twice.
