AOS of k2 rejected , plz help !! I am confused.

Hi

We sent our AOS, AP & EAD (k1 and k2) on 10th feb and they received on 13 th feb. But on 27th Feb uscis sent all our aos forms and documents sent  back with this is "rejection notice" of my k2 son. I signed in the "signature of person preparing form, if other than above" instead of "signature of applicant" thinking I am the preparer . 

 

But I dont understand what is priority date as it is mentioned in this form i-797c -"based on the information you provided, your priority date couldnt be established" i dont understand what does it mean. And also there is mentioned so many forms. i.e. i-130, i-140, i-360, i-526 in his i-797c .it made me even more confused. Do anyone know here which form should we send for the AOS of k2? I sent was

 i-485, i-131 , i-765 and his biometric.

I'm not 100% sure, but it looks like you just need to fix the signature part.  If he's younger than 14, then you sign it.  

 

The second part looks like an example of forms you should include to establish the eligibility for filing (ie the approved k petition)

 

Again, not 100% sure, but that's how I interpreted it.  Hopefully that will help, or someone else can weigh in to confirm what I think or correct me if I'm wrong.

Thankx for the quick response. I signed the form but i think i signed at the wrong place. I signed at the "person preparing form" which i didnt know. 

 

I had sent the i-797, approval of k1 petition. May be they didnt see it. I dont know.

Are you close to a field office?  You could schedule an appointment with Infopass to ask for clarification.

if you came on a k1 did you marry within 90 days? if not you would need an i130 which upon approval would create a priority date.

Hi Raini7,

It looks like my case is same as yours, I actually need help too and I am so confused with our paper works. I filed AOS, AP, EAD for K1&K2 then sent our papers Feb 8, then they received it on Feb 9 UPS overnight delivery, then on Feb 27 I got a mail and it was a returned packaged for my K2 daughter it was a REJECTION NOTICED all 3 forms. ? Then there was a ziplock with with brown envelope with my 2x2 photos on it, I wonder why my photos is in the package instead of my daughter's 2x2 photos. I waited for couple days thinking my papers might be returned too but I never get any mail until today. Does anyone of you has an idea if my papers will be rejected or returned too? By the way the amount I put on the checked is $1,140 for me K1 and $750 for K2, is that right?

Hi, I got Rejection Noticed too for my daughter K2 it is also same as yours I didn't signed the right block that's why. I didn't signed the preparer instead I signed the interpreter that was probably the wrong thing and I didn't put any signature on the Applicant block but I did put my daughter's printed name. Now, What I did with my daughter's form I-485 I signed all the block this time but still I am not sure if that's the right way until I resubmit the package. But now I am wondering also if my package will be returned too since I found my photos in my daughter's package.

How did u find ur photo in ur daughter's package? Only ur daughter's package is returned? Since we sent our fee combined they sent us our both package. So going to send again. I am going to sign only in "applicant signature" block and print my name this time. Even if we print our kids name there it doesnt make sense since they r below 14. 

Now i think "signature of person preparing form" means attorney's  signature if any. But i didnt know before.

You have to send 85$ for ur biometric fee too. Haven't u write ur name  at the back of photo? I think they got mixed up with ur both pics and sent the wring one with ur daughter. I think u ve sent seperate fee of 1140$ and 750$ .thats y when ur daughter's form was rejected , they sent it first and when they found u had not sent biometric fee and urs also sent back.

Yes only my daughter's package was returned, but I don't understand why my photo is there and not hers?. I found all my 6 2x2 photos in an enclosed ziplock, ohh ? I forgot I also sent 3 wedding photos it's also in the yellow envelope enclosed in ziplock on my daughter's returned package, don't know why? By the way did you get I-797 in your form I-485?

 

Thank You Raini7, I am going to erase her name and put my name since I agree that it doesn't make sense if I put her name there. And as well as the preparer, silly me ?

 

I was going to send it Yesterday if I got my K1 papers back so I can send them back at the same time, but I never get any returned mail today either for me. Tomorrow I am going to call the customer service if my papers are coming back or not and why my 2x2 photos are found in my daughter's package.

Yes, I did wrote my name at the back of the photo. Yeah I am thinking they probably got it

mixed up, but when I found out I didn't pay for biometric I started to think my papers was coming back the next day but it didn't, so now I am debating myself if should I send my daughter's papers and don't wait for mine, I really don't know what to do, I am really confused. But I am also thinking of ordering a check for $85 then send it with my daughter's package without waiting for my papers to come, but what is the possibility that it's not going to work instead my check will be lost?

Yes i got my three i-797 for i-485, i-765 & i-131. I think better u should call uscis . I m not sute but i think they ll send ur also back. 

I called on the same day i received my package on feb 27. But the officer couldnt find my receipt No. in the system coz they had not put it yet. So couldnt find out what was the reason of rejection coz i looked only into my i-797c and later i saw there was 6 i-797. 3 of my son and 3 are mines. 

 

Am trying to send it tomorrow

Good luck to you and your son's paperworks! And Thanks for all your responses. I'll keep you posted with our case as well. I called the USCIS right away after I received my package and same thing they couldn't find my receipt number and the system will be updated in 30 days before it show up, they said. But tomorrow I am going to call USCIS again. Crossed fingers I get good response also.
