Iranian citizen Pending h1b extension approval

Timeline

Hi everyone 

I am an Iranian citizen married to Indian citizen who holds h1b. Currently extension is filed and we are waiting approval. Considering the new proposed  travel ban on Iranians, wondering is there a chance that my extension can be denied or get delayed approval. Is there anybody Iranian here whose extension got approved in past 1 month. We are planning to visit India Iran if the extension is approved. My h4 visa has been approved twice before of course  it took 2 months for 221g to clear. This time are the odds of denial or delay high? Anybody got visa stamped recently ? Please advise/reply

No way to know. Last report I saw is that the upcoming executive order will not apply to current visa holders. It would be up to USCIS and DOS lawyers to determine whether visa extensions would be prohibited or paused as well.

 

You will need to wait until the order comes out and USCIS issues some guidance.

USCIS Will Temporarily Suspend Premium Processing for All H-1B Petitions

Starting April 3, 2017, USCIS will temporarily suspend premium processing for all H-1B petitions. This suspension may last up to 6 months. While H-1B premium processing is suspended, petitioners will not be able to file Form I-907, Request for Premium Processing Service for a Form I-129, Petition for a Nonimmigrant Worker which requests the H-1B nonimmigrant classification. We will notify the public before resuming premium processing for H-1B petitions.

Who Is Affected

The temporary suspension applies to all H-1B petitions filed on or after April 3, 2017. Since FY18 cap-subject H-1B petitions cannot be filed before April 3, 2017, this suspension will apply to all petitions filed for the FY18 H-1B regular cap and master’s advanced degree cap exemption (the “master’s cap”). The suspension also applies to petitions that may be cap-exempt.

While premium processing is suspended, we will reject any Form I-907 filed with an H-1B petition. If the petitioner submits one combined check for both the Form I-907 and Form I-129 H-1B fees, we will have to reject both forms.

We will continue to premium process Form I-129 H-1B petitions if the petitioner properly filed an associated Form I-907 before April 3, 2017. Therefore, we will refund the premium processing fee if:

  1. The petitioner filed the Form I-907 for an H-1B petition before April 3, 2017, and
  2. We did not take adjudicative action on the case within the 15-calendar-day processing period.

This temporary suspension of premium processing does not apply to other eligible nonimmigrant classifications filed on Form I-129.

my husbands employer has converted his extension to premium considering the premium processing pause that will take effect from April 3. Hoping my h4 extension doesn't get denied in lieu of the new travel ban and We won't get any RFEs

- in the travel ban text under exemptions section, one exception  includes citizen from the ban countries wants to travel to join close family like spouse ( us citizen or GC holder or alien admitted to usa lawfully on a non immigrant visa ) or child will be allowed to travel. Does this mean H4 visa applicants (like me) will get visa approved and allowed to enter ?

- under the new ban, iranians already in usa can file i-485 ? Usually how long does I-485 processing take for Iranians under eb2 category ..member who have already received GC can please comment their timeline
