Because they do. 

The AR-11 and I-865 are totally separate forms, and both have to be filed, as @Name O Boy said. If at any point in the past someone has completed an I-864 Affidavit of Support for an immigrant, they are required to file I-865 any time they have a change in address, whether the immigrant also moved or not. That applies for as long as the sponsor remains financially responsible for the immigrant.

OK, but that's not what was said:

It does not make sense that if the immigrant moves, the sponsor ALSO has to send in a form regarding the immigrant.

There is two change of address forms. One is for the applicant the immigrant spouse(AR-11 form)  and one is for the U.S citizen the sponsor(I-865 form). If both of them move then they would have to send two forms one from the applicant and one from the U.S citizen or if one of them move and still married the one who moves needs to notify USCIS by sending his/her relevant address change form. If the applicant becomes U.S citizen then they don't have to send address change forms. I hope it clarifies your confusion.

Yes, but I think @Name O Boy was implying that if the immigrant and sponsor are a couple, and they move together, then both need to file their own form. Many of us have, in the past, wrongly assumed that only the immigrant needs to file a change of address with USCIS when both partners are moving together.

@theanswerisdance Thanks for your assistance :) I posted it here because I read a thread yesterday where one spouse sends the address change form and the other didn't have any clue and they realized after a long time that they forgot to send the form. The form I-865 instructions say that the sponsor should notify USCIS within 30 days of the address change. Some folks did send the form late without any issue. I thought it would be helpful to share, I am praying for a smooth process for all of you. Regards

I filled out the AR-11 when we moved but didn't know anything about one for my wife to fill out.  Will follow up on that today.

actually, more questions (also posted as seperate thread): 

 

"So I'm in the removal of conditions process right now.  Just moved to Maryland from California as my wife has graduated from her Masters Degree and is seeking full time employment, and filed an AR-11 online right after we moved here (on July 26th, 2017).  I *thought* this is all I had to do, but see in the filers thread for my month (March 2017) that the sponsor also needs to file if they move house.  So my wife is my sponsor *BUT* she was a student when she filed so didn't meet the income threshold, so my Brother in Law filed and affidavit of Support when we originally filed back in 2015 for the original greencard.  He has since moved house, (possibly around a year ago).  My wife has also moved with me to Maryland. 

 

Question: 

 

a) does my wife need to fill out the I-685?

b) does my brother in also also need to fill out the I-685?

c) do they *BOTH* have to fill out the I-685? 

 

Are there any penalties for my brother in law not filing his if it was required already? Or my wife not filing yet? 

 

I've tried calling USCIS, but we all know its impossible to actually get hold of a human being there. "

A) Yes (I-865, not I-685)

B)Yes (I-865, not I-685)

C) Yes (I-865, not I-685)

Anybody who has signed an affidavit of support for you is required to update their address when they move. 

 

Per USCIS, there is technically a penalty, but I haven't heard of anybody being hit with it. (doesn't mean it hasn't happened, just not that I've heard of). Still, do it ASAP. I suspect they'd be more likely to come after the sponsors on this issue if they discovered the immigrant had been receiving means-tested benefits.

There is one sponsor in one of the thread he/she filed the I-865 one year late without any problem. Honestly not many people know about it. I came to know about this form just a few days ago and I realized it is important to post it here. I would recommend to file it even if you are late with a note describing the reason for filing late. Regards

If you are within the one-month of address change timeframe you don't need to write a letter or note with your I-865. You have mentioned you already send AR-11. The letter is not required but if a sponsor is late to send the I-865 then I believe it would be better to explain the reason for late filing. There are some applicants who file I-751 late and then they write a note explaining the whole situation. If you are late in filing I-865, my recommendation would be to explain the whole circumstance truly best to your knowledge. It would be pretty formal and nice if you put your details and signature but again it is just my suggestion. Regards

I didn't include a letter of explanation wth my husband's I-865 when I filed his late, and I received a confirmation from USCIS that they had received it a couple of weeks later, no questions asked. To be honest, I would just file it now, and if it is for some reason it's raised by USCIS at a later date, just be honest and explain that you didn't even know you had to file both an AR-11 and an I-865, and as soon as you were made aware of the need to do so, you did it. I would suggest not overcomplicating what in most cases turns out to be a non-issue (that's not to say it's not extremely important to file the I-865 now that you know you have an obligation to do so, but you are not the first person to have filed it late).
