Hello Everyone.

 

I have some confusion related to the Selective Services registration. Let me get to the point including some background information.

 

I was born in November 1989 and entered the USA in April of 2013. I was 23yrs old then and i came to the US on a K1 Visa. I got married and received my conditional Green Card in March 2014 and i was 24yrs old then. I have applied for the Removal of Conditions(i751) in Vermont(VSC) and as they are late, i am still waiting on the 10yr Green Card. I applied the i751 in February 2016 and have been eligible to apply for N400 since December 2016 based on the 90 day rule. Also, i recently(not so recent) celebrated my 27th birthday in November 2016.

 

Now, i was planning to apply for N400 (Naturalisation) before i get my 10yr GC as i believe i can do that and it would save me couple months. While filling the form, i saw this question related to the Selective Service(SSS). Now i did some digging and found out that i was supposed to register for Selective Service before i turned 26 as i became a Permanent Resident when i was 24. Is this true? Also, now that i found that out i cannot apply as i am 27 now. Therefore the question is what am i supposed to do now ? I know that not registering in the Selective Service can cause a denial. I wanted to know if someone was or is in the same boat as me? Any information would be really appreciated.

 

Note: When i entered the US, i was on a non immigrant Visa(K1). Also i did not know about this until i started filling out my N400 application. Funny thing is when i filed the application for the conditional GC, it was through a lawyer and he never mentioned anything even remotely related to this.

There is an way to "prove" you had no idea; but having had a lawyer do your documents and all doesn't help that. Most i think would believe the lawyer would have said something.

 

This is why it is so important people research and look at requirements themselves, even when they have legal assistance. Otherwise you run into these things.

 

Like the link above says though, perhaps wait a few more years even to gain extra time to show good moral character.

Are you sure that the lawyer did not fill the information out correctly and sign you up for selective service?

 

Do you have a copy of your documentation that was sent for your original K1 and AOS?

 

If you do it may pay to go back through and look at it to confirm 100% whether that question was completed correctly.

01/06/16 - Service request 2 submitted

01/19/16 - Interview Appointment Received

02/09/16 - Interview - APPROVED

02/12/16 - 2 Year Green Card In Hand

12/26/17 - ROC Submitted

01/08/18 - ROC NOA1 Recieved

10/06/18 - Received 18 Month Extension Letter

01/17/19 - Removal of Conditions - Approved

01/23/19 - Received 10 year Green Card.

 

My Citizenship Journey

12/06/18 - N400 Submitted

12/18/18 - N400 Biometrics Appointment Received

12/26/18 - Biometrics Complete - Expected completion Feb 2020 (13 Months)

04/28/19 - So far lots of USCIS "nothing has changed" bi weekly status update e-mails.

05/07/19 - Received notification that my N400 interview had been scheduled.

05/08/19 - N400 Interview letter was available to view online.

05/13/19 - Received physical copy of N400 interview letter in mail.

06/14/19 - N400 Interview Passed. Recommended for citizenship.

06/22/19 - N400 Approved

07/24/19 - Oath ceremony scheduled

Yup your application WILL get denied I am afraid. You will have to wait until you turn 31 to be able to file N-400. That is because there is a  5 year statutory period to demonstrate good moral character from the last point of time that you should have registered with SSS. Rotten luck and you should demand that your lawyer give you a refund on legal fees.

  Every welcome to the US package has it somewhere.  Most people don't bother reading it but everyone has been given written  notice of the requirement so it is hard to claim lack of knowledge unless you were brought by your parents.   

This will not be over quickly. You will not enjoy this.

Exactly! That is how I came to know about SSS. I then registered it right away.

I'm sure you might have been registered automatically when you received your conditional gc ... as I was automatically registered with sss without even me knowing what it was... I suggest that you call sss and give them your info and ask them to mail you the official letter by mail.... sometimes you can't see or check your status online as your social security is not updated with them or something.... so I suggest just call them up and you will be relieved... their 1800 number is on the sss website.
