My ex, (divorced in November,) has been making threats again...basing all of her fight on the Affidavit of Support.  I filled out the disillusionment papers giving her nothing.  Just what she deserves, (I'm sure many of you have seen my other posts.)  In the divorce, she got the older car, of which she had to make the remaining payments.  I placed an addendum in the petition that if she misses one payment, the car comes back to me.  Now, because she is a child, she refuses to make the last payment, (I have text message evidence proving her stance.)  I told her I would be moving forward to get the car back.  Some words were thrown around, and she ended up making a veiled threat against my daughter.  Also, threatening to open a case of abandonment.  For the threat, I'm going to the police this morning to apply for a restraining order.  For the car, I'm going to the courthouse to see what my options are.  As far as her threat to file an abandonment case against me, I do not believe she has a leg to stand on.  From what I understand the AOS is there only to ensure she does not become a public charge.

 

Any thoughts or support or words?

It sounds like she is more than a handful.  Having said that however, you would be wise to pick your battles.   If it was me I would make the last car payment ASAP and let her have the vehicle.  Reasoning is your credit and peace of mind is worth much more than an old beat up car.  From my point of view, she is baiting you to stir up some drama and negative attention.  Don't fall for it!   Making the last payment and leaving her be is a way of separating yourself from the situation.  Also, be grateful that she made any payments at all, it could have been much worse!  Good luck..please let us know how it turns out!!

Whats legal is one thing and whats fair another. If she missed only one last payment perhaps you should not be as harsh :( .  Did you give her any settlement?

 

Also perhaps remove your profile pic.  Of course looks can deceive but the picture shows a timid almost child like woman much younger than you.  She didnt leave her world to be alone in a new country, perhaps theres her persepective too.

She is NOT timid...definitely a child though.  I'll remove my profile pic soon...never even thought of that.

She left her world willingly and she if far from alone.  She's been here the better part of 4 years now.  No, my friend...she had a plan.

She is working and makes more than enough to meet the poverty level.  She has zero case I think.

Exactly, she is asking that you support her to the poverty level, but her income exceeds it, so no case.
