I just got RFIE on my online status.. I was expecting it.. So our story is that Me and My U.s citizen Wife are doctors, but we still don't have a licence here, we studied Medical school in our home country , but my wife's family are all here in the US.. She came back here after our engagement , 1 and a half year ago..and She started working a part time job while preparing for her exam and waiting for my K1 visa .. So when we sent the papers , her sister was the only sponser, because my wife didn't file taxes before.. And we didn't explain that, her income was only around $10k , but her sister's income is more than enough.. We sent her 2016-2015-2014 taxes

This was super useful to read, thanks californiansunset! so we sent in my husbands 2015, and 2016 tax return but no letter or pay stubs, thinking now that there may be a RFE for us too. Does this hold up the wait on getting EAD and AP? or do those carry on being processed like normal, and the RFE just holds up the status adjustment?

I'm very new to learning about all of this, and the entire process, so everything confuses me. I really wonder how I managed to pull my entire visa application together in the first place.

Just a quick thank you to everyone on this forum, because the posts are really useful, and reading everyone elses journeys, is making it easier to not think about the long wait i'm about to endure.

Stay strong everyone! :)

Your post caught my eye because it was the first I'd seen about sending paystubs and W2s! I just re-read the instructions (for the millionth time it seems), and in my case just due to blind luck, I'd sent a tax transcript for 2016 rather than the tax return, so I don't need to send the paystubs and W2, BUT, it turns out I didn't fill out section 19 properly. I got completely confused thinking I only had to complete the most recent year, but reading it again, I should have filled out all 3 years, but only needed to send documentation for the most recent year. Another reason I'm definitely getting a RFIE :(.

I have a question regarding the Biometrics appointment: I have to use my passport as my ID but it's the one with my maiden name. I applied for AOS with my new last name. Am I good if I take my marriage certificate with me?

I don't have a Georgia driver's license yet...

Definitely take the marriage certificate with you!

I actually took the name of my wife and it's uncommon for men to do that. When I went to my appointment, the lady that was taking care of things got confused and asked me about the name. I told her that I brought the marriage certificate and that cleared up all questions she had. It wasn't an issue at all but she did say that she was happy that I brought the license with me.

Good luck.

If you submit the Tax Transcript you don't have to submit the W2 that's correct. However you still have to submit either a current employer letter OR paystubs from the most recent months.

Edit: just read the instructions again, you're right! Then how come they ask for that sometimes when they send out RFEs for the I-864?

I'm also adjusting my status from F-1. They received my documents on the 16th, just 3 days after yours. However, I haven't received any texts/messages yet :(. I'm starting to worry now. Hope my package is ok :(

Please forgive me for my slow response, my mother-in-law is visiting us and we have been quite busy with all the shopping and spending time together!

I understand your frustration...but as lot of people said here, everyone's case is different and taking longer to receive NOA from USCIS doesn't mean there's something wrong with your case! Hang tight and be sure to let us know when you receive NOA!:)

Hey guys, I have been reading everyones post,

I think we will get a RFIE too. We did not send in a G325A or the new form I-130A(?) filled in by my husband, so that sucks. I hope it doesnt delay to much.

Also I hear people say that they need 6 photographs. That is not true, I did quite some research on it, and 4 is enough. A friend of me got accepted with just 4 photographs. 2 for EAD and 2 for GC. The AP is a combo card, so they will use the ones u send in.

Pretty bumped now tho with this extra delay, I thought I did all my research. It was not in the AOS guide at least.

One more thing, I tried looking the case status up and it does not find it. Is that normal? And mine starts with MSC, which one is that? Or is all the AOS with the same thing?

Congratulations and hopefully they will sent the texts and emails as well as NOA1 ( form i797C) to you soon. Good luck

I think it should not be that and I do not think USCIS is not tribalistic in handling cases. Be strong and positive. Good luck.

Congratulations and good luck.

Only one email and phone number is needed for updates, if your husband got them, that is fine. Congratulations so far and good luck.

Congratulations and good luck. It is your choice to arrive earlier at the ASC (#my opinion though)

Congratulations and sure that will come in less than two weeks from now. Good luck.

Thanks a lot@ Atuegwu its mind draining and alotta suspenses and waiting but will all sail thru by the name of the almighty . Wishing everybody d best on this

I didn't receive any emails or texts, even though I too filled out the 1145 form. My husband got all emails and texts. I don't think USCIS cares that much about this aspect of our application.

If you create an account on USCIS.gov, you can get notifications for the various case numbers you received. Just keep in mind it sometimes takes a couple weeks before you can start tracking.

To 99% it's something about the I-864. People always do something wrong with it or didn't send all required documents. Check it again whether it is correct.

Also as I said before in a post for someone else, if you haven't had your biometrics yet I wouldn't worry about it too much. They don't start processing your application anyways before they didn't get the biometrics.

Yeap didn't have my biometrics yet. I hope it won't effect.

Hi guys,

I've just realized that I sent the new form I-130, and I included the form G-325A instead of I-130A. Will they send my package back to me? Or will I just receive an RFE?

This is the first time I had heard about the i130..... Kinda panicked!

I did check the USCIS website, I was getting ready to print off the form, but then realised the i130 wasn't same form I have used. Just to check @Pinkielicious what edition of form did you use cos it says this:

  • "If you are using the 02/27/17 edition of Form I-130 to file for your spouse, you must also submit a Form I-130A, Supplemental Information for Spouse Beneficiary."

Then i panicked because the edition now on the website isnt the same as mine at all, but then turns out:

  • "If you are using the 12/23/16 edition of Form I-130 to file for your spouse, you must also submit two Form G-325A, Biographic Information: one for you and one for your spouse.  Do not submit Form G-325.Please read our Lockbox Filing Tips."

which is the form I have used, and:

"Starting 04/28/17, USCIS will only accept the 02/27/17 edition. Until then, you can use the 12/23/16 edition. You can find the edition date at the bottom of the page on the Form and Instructions."

so all in all, @Pinkielicious if you have used the 12/23/2016 edition then you did not need to submit i130, you only needed to submit the G325A :)

AOS Journey

03/25/17: I-130, I-485, I-131 & I-765 packet sent

You know what, I used the old I-130 at the very first time, but I made a mistake on the form, so I had to print out a new one. However, I didn't even pay attention to the version date as well as the instruction even though I DID realized that the form is a little bit different. That was why I just filled up the I-130 and kept the G-325A as it. Until yesterday, I read someone's post regarding the new and old version of I-130, I then realized that I had made such as silly mistake. I hope they won't send the whole package back since it's already been 17 days when they received the package, but I haven't heard anything from them.
