So what USCIS sees right now is "Great her husband made enough money in 2015 to support his wife... but there is no proof of sufficient current income". You had to write his current income in the I-864 where it was asked but you should've somehow backed it up (paystubs or employer letter).  Otherwise people can write whatever income they want in there to get approved although they make a lot less in the current year. I'd be surprised if you didn't get an RFE for that. Just have all documents ready so as soon as you get the RFE you can respond. Also, have you tried looking with the search bar whether someone else had ever made the same mistake?! Maybe you will get your answer there whether you get an RFE for sure or not. 

This was super useful to read, thanks californiansunset! so we sent in my husbands 2015, and 2016 tax return but no letter or pay stubs, thinking now that there may be a RFE for us too. Does this hold up the wait on getting EAD and AP? or do those carry on being processed like normal, and the RFE just holds up the status adjustment?  

I'm very new to learning about all of this, and the entire process, so everything confuses me. I really wonder how I managed to pull my entire visa application together in the first place. 

 

Just a quick thank you to everyone on this forum, because the posts are really useful, and reading everyone elses journeys, is making it easier to not think about the long wait i'm about to endure.

Hi guys,

 

I've just realized that I sent the new form I-130, and I included the form G-325A instead of I-130A. Will they send my package back to me? Or will I just receive an RFE?

05/13/2017 - Received I-797C for I-485/I-765/I-131 in mail (USCIS couldn't find my record for I-130 approval)

Call them ahead of time and find out. Some ASC's allow walk-ins at any time as long as you have your appointment letter, others only let you in the day of your appointment. If I had to guess 2 hours earlier won't be an issue at all though.

Oh no! Did you submit your husbands W2s though?

 

USCIS wants to see that the sponsor can also support his/her partner during AOS that's why they want to see something current. Paystubs or employer letters are the only way to verify this. If you submitted the W2s they can see that your husband had work until December. I don't know whether they see that as recent enough. If it was January or maybe even early February right now I'd say you might be good and they'll just ask you to bring those documents to the GC interview (if there is one) but now it's March, so even the W2s might not be enough proof that he is currently employed. Sorry :(

 

If it is a request for initial evidence (which I think it would be) then it unfortunately also pauses the EAD. When it's a normal RFE for the I-485 everyone says something different. Some people say it pauses the EAD too as they are connected and some people say it doesn't.

You should also include the I-130A form if you have sent the new I-130 since it says on the USCIS website under instructions for filing I-130 .Did you also send in the most recent paystubs too and if you did then you might be fine regarding the financial part of it ,but you may receive a RFE regarding the I-130.

My heart sunk when I read this. I just sent my docs on 3/29 and it arrived today 3/31 and I also missed this! I had extra passport photographs, but didn't realize I needed them for EAD and AP so they're sitting on my desk at home. Also now that I'm re-reading all the instructions, it appears I also didn't include the fee for EAD. I thought like AP it would be included with the fee for I-485. This is exhausting :wacko:.

I had filled up the old I-130 form, but I made a mistake, so I printed out the new one. I didn't even pay attention to the date of the form, so I just redid the I-130 and kept the G325A as it was. I didn't send any paystub, only the W2 and tax transcripts. Do you think they'll ask for it?

I feel you since I sent my form right before they changed the version and was lucky there. The reason they could ask for paystub is to verify if your husband is still employed or not. Again do not quote me as every case is different and I sincerely hope they process your application without any RFE , as a few of them on this forum had sent the wrong edition of the I-130 but still were lucky enough to not get a RFE.
