yes that is correct. However the interview gets waived while the case is still in Missouri not when it was transferred to the field office. It gets transferred to be scheduled for an interview, not to have it waived. The Tier 2 likely communicated the wrong info that it was transferred to a field office even though it hasn't (happens more often than you think).

That was my point... I am obviously aware that K1s before October 2017 can have their AOS interview waived.

Speaking from personal experience (since I’m a K1 with an approved GC with interview waived) I think you are incorrect on this one. I spoke to multiple Tier 2 officers and had a senator enquiry answered by my local USCIS office. Again I’m only talking about K1 fillers, NBC recommends an interview waiver and case is sent to the local office for final approval. All k1 AOS are sent to local offices independently of interview waiver or not. The local office might then decide to approve issuance of GC or invite applicant for an interview. As I said that’s how the process was explained for K1 AOS by multiple Tier 2 officers. Btw just emphasising the point that always ask to speak to a Tier 2 officer as they are the only ones that can give you meaningful updates.

According to the USCIS website the National Benefit Center determines whether interviews will be waived or not https://www.uscis.gov/sites/default/files/USCIS/Outreach/Notes from Previous Engagements/2012/April 2012/NBC-FloridaBar042412.pdf This is why Tier 2 often say "your case is still at NBC so it looks like the interview will be waived...blabla". It rarely happens that they are taking the extra step to send a case to the local field office to then have it waived... usually when sudden backlogs at the local field office happen it is the only time this might happen.

The tier 2 officer have so often given out false info to people on VJ it doesn't surprise me at all.

Hey, I'm a February filer but would like to know what you meant by 'before October 2017' - did something change? And filers after October 2017 can't have their interviews waived? Curious..

Any K1s who filed in or after October 2017 won't have their interview waived anymore. All visa categories (both K1 and E-visas who had them waived sometimes) have a mandatory AOS interview now....thanks to Trump. A lot more workload while the amount of USCIS employees remain the same... happy processing times!

Yesterday I called costumer service and spoke with a Tier 2 officer. I asked If he could provide me any information regarding my case, since next month it's going to be an year since I filed. He wasn't able to inform me a estimate date for approval, but he could tell me that my case is now in my Field Office and that it was eligible to an interview waive. Also, he said that I was not in the interview queue, so it is most likely that I won't have interview at all. I know that it is not a final answer, but is good to have some information at all.

I know some of you already know that, but if you guys try to call Costumer Service I highly recommend ask to be transferred to a Tier 2 Officer. I asked the same questions to the fist person who answer the call and it was a complete waste of time. She just told me the processing times that I can access here: https://egov.uscis.gov/cris/processTimesDisplayInit.do . The Tier 2 Officer was really nice and solved all my questions.

Hi guys!

Please can you advice on how to talk to a Tier 2 officer? WHat are the steps involved to do that?

Also, can anyone give me an example of the letter/email you sent your senator/congress person?

Thanks!

Very upset and discouraged.  We've been waiting and waiting.  Last update in March of 2017 was that they'd received the request for evidence (they wanted copies of bank statements we'd already sent, but whatever, we sent them along with many more months than requested).  Now we get a new letter today thinking it will be the interview date.  Nope, RFE now they say we need a new medical examination and vaccination record because the one we submitted is more than a year old.  I get the feeling we just went to the back of the line again and will now have to request new EADs since they will expire in July.

I got on here today to ask about a new medical and saw this. My husband had his first medical in March of 2016 and we applied for AOS in February 2017. Its coming up on 2 years since his medical. Our last status is fingerprint fee received. No RFE but the Houston office is estimated to take 1.5 years from time of application to get interview. Do we need to do another medical or is it only needed when it’s over a year old at time of AOS application?

I don't think you would move to the back of the line. After all the RFE was because of USCIS delay and no fault of yours. PD would remain the same. On the bright side they did reach your case! Its better than getting an REF at the interview for the same reason. My PD is right behind you. I intend to do the same - get new set of medicals and apply for EAD and of course hope & pray to get the interview notice soon.
