So I have this question when it comes to my wife getting her US Citizenship.  I know we're far away from it, but I'm sure this is a question that will have different answers and will stomp you guys.  So here goes (I am a US Citizen by the way):

 

So my wife and I got married on 2/10/17.  She arrived on a K-1 (fiancee visa) a couple of weeks before that date.  We've adjusted her status for a green card and just waiting to get it approved.  So, let's say the green card gets approved on 11/10/17 (I'm just guessing) and is good for 2 years from that date which means it will expire on 11/10/2019.  Once that time arrives...can she apply for US citizenship since it's 90 days from our 3 year marriage (anniversary would be 02/10/2020) and skip the removal of conditions? Just curious if we still need to apply for the removal of conditions.

You will always have to remove conditions, or at least file all the papers. However you can file all ROC papers and also file for her citizenship once she becomes eligible (2 years 9 months from when she first got her green card) regardless of her ROC status (pending or approved).

Ok, it makes sense.  Just sucks that we'd have to pay the fees for both applications.

Hi, i have been in a car accident, a young girl was driving and she run the stop sign and T-boned me. My car rolled over at least 3 times, i survived with least though, i had cuts on my arm and 15 stitches. 

 

Do you think this will effect my immigration? Crash report is not up yet, it has been 1 week. Trooper told me, she is at fault, she had to yield and she was messing with her defrost because she wasn't able to see from her windows. But still she was pulling her car in middle of the intersection. 

 

I have my EAD my driver's license. But my GC is still in pending. So i don't know if they will think i am legally in here.

First of all, I'm sorry this has happened to you and wish you a speedy recovery!

 

I highly doubt that this will have any affect on your immigration journey whatsoever for a few reasons. 1. You're not at fault and 2. This isn't something like domestic violence that could make officials question your good character. If any concerns about your status ever come up (even though I don't know why they would), show them your I-485 NOA 1. It serves as proof of your authorized stay in the US whilst the I-485 is still being processed. Focus on your recovery and let your insurance / lawyer(s) handle the accident situation.

You only have to be concerned if you did something illegal that was a violation of the law some how.

If you are cited for an offense I would consult an attorney. If not... I doubt it.

You always have to file for ROC because you need a valid greencard to apply for citizenship. :) It is such a money-suck, and ROC tends to take forever to get approved, so many times people will file for citizenship and that kicks ROC into approval so they can get the citizenship done.

 

In other news, I just received the email notifications that my daughters' greencards have been ordered in production (adjusting from K2 visas). I am so relieved - no interview, and they didn't request a new medical even though the visa one has expired by now (it hadn't when we filed). So so relieved!

Hi All,

 

Hoping to get some sort of answer. It's been 209 days since our I-485 application was received at the Chicago dropbox location. My wife has her EAD/AP combo card already (since May 19th). Our case is currently at the Lee's Summit, MO office (National Benefits Center). However, our case has been sitting at "Fingerprint Fee was Received" since March 2nd, 2017. Anyone have similar cases? Time frame on when we can expect to get an interview?

it has been 206 days since i filed and 161 days since they got my answer for RFIE. I don't know why it takes so long.

I see you are in California. If you are in a sanctuary city, I'm pretty sure they cannot even ask your immigration status. The only time this could potentially be a problem is if you are prosecuted/convicted. Since you are at no fault, you should have no trouble. Did you get a ticket? If not, you should be ok.
