In my case, even though we've been married 10 years in the USA. An interview is mandatory.

USCIS needs time to get our paperwork together..

... it bums me to wait while other people are getting waivers but I understand the importance.

It's the only chance immigration has to ferret out fraudulent marriages...

hey @britontherun, i do agree with @KimberleyVDB here as only people adjusting from K1 can get visa waivers as their sole purpose in coming to the US on a K1 visa is to get married to a USC but F1 holders have to attend a compulsory interview as there are conditions attached to an F1 visa one of which says very specifically that you shouldn't have the intend to live here permanently after school is done... I don't know whether F1 to AOS applicants get faster processing (i really don't believe so) but i do know that if your interview gets waived(adjusting from K1) its usually a longer wait than if u get an interview especially if your local office is a smaller one (I'm basing this off of people's timelines on here as well as from youtubers that i have watched go through this process)... I really cant guess which one is easier on you, having to go through the interview or having to wait longer but given a choice (especially now, since my interview was a breeze :D) I would totally choose to have to go through with the interview as i cannot handle the waiting very well even though I have waited much less time than most people on here... (70 days from PD to interview and 75 from PD to today). hope you get good news soon one way or the other...

 

 

 

BTW Received NOAs saying welcome to America for me and your application is complete for my wife(for i-130) today... status still saying card is in production... Tickets booked, bags already packed flying out on the 22nd hope i get the GC in hand at least by the 19th... Fingers crossed...

Timeline so far:

May 23rd    : Sent i-485, i-130&130A, i-131 and i-765 along with supporting documents at around 6PM via UPS next morning delivery.

May 24th    : USCIS received packet at 10 AM.

May 31st    : 4 texts and emails NOAs for all the applications and signed up for case status account.

June 2nd    : NOAs in the mail.

June 9th     : Bio-metrics appointment notice dated June 2nd. Appointment scheduled for June 20th.

June 12th   : Bio-metrics done, Walked in with an infopass appointment that nobody asked for. They didn't even ask why i was coming in early.

                      The person who dealt with me was very nice and welcoming.

July 3rd       : At 11AM received an email saying your case status has changed to interview is scheduled for August 2nd...

August 2nd : Attended interview was approved on the spot... IO was nice professional and polite but not friendly...

August 10th : At 2PM received my Green card in the mail!!!!

Heck yeah I rather have an interview because than I get a letter with a date to live towards. The waiting with not knowing how long, especially since I haven't seen my family for over a year, is driving me nuts sometimes. But it's all I can do, so I'm trying to stay positive and keep waiting.

See, that's the thing - K1s have already been interviewed to establish that theirs is a bonafide relationship - and the visa has the specific intent of marriage and follow-up AOS. Why re-interview? There's really not much to gain from it. For all intents and purposes, USCIS has already deemed your relationship to be valid, and AOS is merely paperwork to make sure you kept with the terms of the K1 visa.

 

Other visas, though, are not given with the intent to AOS based on marriage, so when it happens, they want to make sure the marriage is real and valid - hence the interview. The interview you had before entering the country has nothing to do with the relationship you later developed with the USC spouse.

 

Even though there is no rhyme or reason to approvals, the trend I see is that non-K1 visas get sent to field offices for interviews, whereas K1s get approved with a waiver - which can take longer. They used to issue waiver letters - I received one when I did my AOS - but they don't anymore, I don't know why. Anyway, that's why I asked.

Hi guys. So far I went through this process without any obstacle until today. I would like to know if you have similar situation. 

-EAD went smooth. (Received on July 26th)

-SSN went smooth. (we went on July 28th)

-Driving license went smooth

 

Yesterday, I accepted a job offer and they put my information into the e-verify. However, I received a TNC (Tentative NonConfirmation) because information they have entered differ from what SSN or DHS have in their system. The lady thinks it is because my SSN is so new but I never heard anyone here have the same problem and people seem to get their job relatively quick after their EAD...It makes me worried a little bit..

I meant to write this post earlier, but my husband received his greencard! He was adjusting from a B2 visa. Our interview was July 18th in Chicago.  We had to wait for a long time (didn't start interview until about 45 min after our appointment time), but it seemed like that was because of some odd case with the interviewees before us.  Ours was over within 20 minutes, the man was friendly and didn't have too many questions, just flipped through our initial submitted evidence and asked me for the copy of our lease that we had just renewed the week before. He asked me how we met, if we had met each other's parents, and then everything else almost was just casual conversation really. He told us he would approve our case and we received the card in the mail one week after the interview! What a great feeling :)

Hello, I am sorry I can't help with your problem. But I am wondering if you could tell me did DMV need your SSN to give your Driver's liscense?

Got my card finally! After a headache trying to chase down the letter because it was mailed to my old address, I contacted USPS and they were able to hold the letter at the post office for me before it was out for delivery!

 

I'm so relieved!! Good luck to everyone stil waiting!!

Hey guys , looks like a ton of people are moving forward! My husband and I are still waiting for anything!! EAD and AOS we are approaching 90 days since they recievied the info from the RFE so fingers crossed we hear something in the next few weeks!!!

Hi all, I have a question. Is it possible to know where your case is at? My I-797 receipt starts with MSC so I thought it is in NBC. But when I look at processing time for I-485 in  the webpage of USCIS I see no row for I-485. I can see it for I-765 and other forms.
