hey... you r from buffalo too... you will probably end up getting the green card without the interview  probably coz otherwise you should have gotten an interview date by now... hope u hear good news soon...

Yes, I am from buffalo, we talked the other day ! :P I think my case is being processed by NBC. I believe the time it takes buffalo office to process cases doesn't affect my case. I almost would rather have an interview at this point. By this time next month you will almost have your card in your hands. I think you applied 2 months after me so maybe I would have my card in hands right now :P I decided not to be frustrated by the process anymore. I hate when I spend energy on negative things I have absolutely no control on. It just makes it worse. =)

I think the first three alphabets in receipt number says where your case is being processed. Mine starts with MSC so I think it's NBC in Missouri. Please correct me if I am wrong.

I have been waiting for 119 days since filing AOS and EAD. No RFE/RFIE. From what I have seen, NBC seems to have the longest wait period for AOS and EAD.

Oops sorry... i was just excited to see buffalo and forgot we talked lol... :D not too many people from buffalo on here, saw another person from here applied in February or something and had their card in hand by April...

I'm just glad i can have the interview before i have to leave the country to go to my sisters wedding... i will feel much safer traveling with a green card than with just EAD/AP card... decided to extend the trip to 2 weeks because of that but still haven't pulled the trigger on the tickets coz i want to have GC in hand before i do that... now I'm just stressed out about the interview lol... i think i will only breathe normally after the interview is over, till then higher pulse and blood pressure lol...

mine starts with MSC too... i think AOS timing just depends mainly on local office if you have to have an interview and the rest like EAD and AP take very similar amount of time for everyone(+ or - 15 to 20 days)... of course there will be extremes on both sides of the norm...

There's nothing that says that EAD&AP are being put on hold and the AOS is "set back to 0". It only says your application is being put on hold. To my understanding, since most of us filled them together, all of them are being put on hold and released at the same time. There's no mentioning about resetting everything to the beginning. And to me personally it wouldn't make any sense either, If they did some work on it already, they will just stop for the time until they get the response, and then pick up where they stopped.

Ugh, with the current processing times does it even matter? There's no more "90 days" rule, or anything like that. Waiting time in Houston is currently 11 moths. Maybe it's about time to hire more people to process the applications in semi-decent time, because what's happening now is ridiculous. I'm very thankful for them approving my EAD expedition, but damn, if I wouldn't be so lucky I'd still be out of job, probably bored to death, going crazy talking to my dogs only all day long, not being able to leave the neighborhood, since there's no public transportation in suburban Houston are.

Most people have the "resetting rule" from talking to an Immigration officer. Whether it was someone on the USCIS hotline who read their "resetting to 0" phrase off of their computer screen to the Immigration tier 2 officer or also the service request answers I got... they all told me an RFIE resets the time clock. There are obviously exceptions with cases that didn't seem to get affected by it. At the same time there are cases with waiting times of 140-170 days from the Nov or Dec AOS forum that waited that long for their EAD because they got a RFIE in March and didn't submit the response until early May.

I am on day 135 now... it's been 100 days since my RFIE. The standard answer that i got everywhere was that the RFIE resets the waiting time...

For everyone who is saying that there is no proof on the USCIS website that an RFIE MIGHT reset the processing time back to 0:

"One exception to this rule is if USCIS requires initial or additional evidence. If initial is evidence is requested, the processing time will start from zero upon receipt of the requested evidence. If additional evidence is requested, the processing time limit is extended by the amount of time it takes for you to receive the request for evidence and respond to it. Also, the processing time is extended when a request for evidence is issued for any form filed concurrently with Form I-765."

Or:

  • If we issue a request for initial evidence, the date for calculating the processing time will start over from the date we receive the initial evidence.
    • For example, if your case has been pending for 60 days when we issue a request for initial evidence and you respond 30 days later, the date for calculating the processing time will start on the date we receive your response
  • In certain categories, we cannot process your Form I-765 until after we approve another application/petition because that approval is the basis for your application for employment authorization.

If we issue a request only for additional evidence, the processing will stop the day the request is issued and resume  from the same point when we receive the additional evidence.

  • For example, if your case has been pending for 60 days when we issue a request for additional evidence and you respond 30 days later, we will resume processing your case as though it is day 60 on the date we receive your response.

Initial evidence is any piece of evidence specified by regulation or specifically requested on the form or form instructions.

Additional evidence is evidence that beyond that which is required by the regulations, form, or form instructions, but which may assist in proving eligibility where the initial evidence submitted does not.

Yes an RFIE (INITIAL) resets the waiting time, not a normal RFE which is for additional evidence. Thus I submitted sources that talk about what happens when you receive an RFIE.
