Also look at other members here. @emchappie I believe has similar timeline with RFIE and sent RFIE response later on, however, I think card was either mailed or already received. So there is no real fact if RFIE resets or puts EAD/AP on hold.

yeah according to the USCIS website it should reset  but according to people here there have been lots of exceptions where people got their EADs within the original 90 days itself... i hate all the confusion... wish they would streamline the processes better... more knowledge would help people applying...

Timeline so far:

May 23rd    : Sent i-485, i-130&130A, i-131 and i-765 along with supporting documents at around 6PM via UPS next morning delivery.

May 24th    : USCIS received packet at 10 AM.

May 31st    : 4 texts and emails NOAs for all the applications and signed up for case status account.

June 2nd    : NOAs in the mail.

June 9th     : Bio-metrics appointment notice dated June 2nd. Appointment scheduled for June 20th.

June 12th   : Bio-metrics done, Walked in with an infopass appointment that nobody asked for. They didn't even ask why i was coming in early.

                      The person who dealt with me was very nice and welcoming.

July 3rd       : At 11AM received an email saying your case status has changed to interview is scheduled for August 2nd...

August 2nd : Attended interview was approved on the spot... IO was nice professional and polite but not friendly...

August 10th : At 2PM received my Green card in the mail!!!!

This is a quote from the USCIS website. To my best understanding RFIE does not put you case back to day 0, they just out a hold on it and nothing gets done until you submit missing documents. I got the RFIE for missing I-130A which I submitted already, but if I'll have to wait almost 12 month for the GC now my EAD will expire by then... I honestly don't know whether I'll have to re-apply for new EAD or if I'll be able to qualify for automatic extension for 180 days...

so this is where the confusing part comes in... now after having read that what i understand is that your EAD/AP processing just gets delayed the number of days from the day they sent out the RFIE to the day they received your response, right? The AOS application btw gets set back to day zero? would love clarification on that if anyone can provide...

There's nothing that says that EAD&AP are being put on hold and the AOS is "set back to 0". It only says your application is being put on hold. To my understanding, since most of us filled them together, all of them are being put on hold and released at the same time. There's no mentioning about resetting everything to the beginning. And to me personally it wouldn't make any sense either, If they did some work on it already, they will just stop for the time until they get the response, and then pick up where they stopped. 

Ugh, with the current processing times does it even matter? There's no more "90 days" rule, or anything like that. Waiting time in Houston is currently 11 moths. Maybe it's about time to hire more people to process the applications in semi-decent time, because what's happening now is ridiculous. I'm very thankful for them approving my EAD expedition, but damn, if I wouldn't be so lucky I'd still be out of job, probably bored to death, going crazy talking to my dogs only all day long, not being able to leave the neighborhood, since there's no public transportation in suburban Houston are.

This is definitely confusing because i have the response email for the SR i submitted and it says in plain english. 'our systems show that we received your response for your RFE on your form I-485 on May 15th. Your form i-765 will be processed within 90 days of the receipt of the requested evidence' 

 

this means im reset back to 0. :crying:

3/27 aos sent

4/4 check cashed 

4/4 received texts case accepted (pd date)

4/10 received NOA 1 in the mail

4/15 biometrics appt letter received

4//27 had fingerprints taken

4/28 rfe - lost marriage cert 

5/5 mailed marriage cert to uscis

5/15 status changed to response to rfe received

6/13 status changed to 'ready to schedule for interview'

6/22 sent SR for EAD 

7/1 SR response 'due to rfe response received on 5/15. 90 days processing starts on 5/15. 

7/13 100 DAYS MARK from aos date 

7/23 Received eap and ap approval letters

7/25 status changed to 'card was mailed'

7/28 Received ead and ap combo card! 

8/4 4 MONTHS SINCE 4/4 

8/12 130 day mark from AOS received date

9/1 150 day mark from AOS received date

11/2 received an interview date for 12/11

@Kalciaa i get your point, but can you understand mine? i searched everywhere on the USCIS websites (that i could find) and I could not find it written anywhere about the reset but the two things that make it confusing again is the fact that people actually have reported getting these notices like the one above and they don't match the actual wordings on the website and also an RFIE would mean they found something missing from the initially required documentation, right? so basically, if they stop the clock then itself, that kind of means that the clock stays at zero as your application is not complete till you send in the evidence right?... BTW according to the website there is still a 90 day rule (even though most people are only getting EAD processed between 100 and 120 days after PD) and there was never one for AOS its always been only for EAD/AP just saying that coz u mentioned the 11 month waiting period(i know u know this... just wanted to mention it)...

 

and @ndwedding I'm sorry about your situation, did you try to get in touch with your congressman? coz my congressman has a website on which he has a specific link for helping with government/federal paperwork not being done on time...

I understand what you're saying and I know there was never 90 day rule for AOS. But as a person who deals with contracts and funky wording on daily basis I choose to hold them up to what they provide in writing on their website, since answers from their representatives vary from one person to another. As probably most of us already noticed there's very little sense in order they process the cases, I'm assuming it depends on the specific person processing our cases. As we said multiple times here before, after submitting our request there's not much left to do other than wait.

I havent thought about it, so you think its not within processing time if they are saying only 60 days in? technically im  102 days in. I'll talk to my husband to see if he wants to do this. thank you!

that last sentence is sooo very true, waiting is all we can do... this whole discussion came about because i said RFIE sets your clock back to zero days and you said it just pauses the processing... from reading back through all those comments what i want to ask is unless you get an RFIE after 50 or 75 days(which i haven't seen yet but surely there might be 1 or 2 out there) wouldn't the RFIE be issued during initial processing ? so essentially your clock would get stuck on zero or at least a very low number of days like 1 or 2 when it is paused, so that would be almost the same as  your clock getting reset, wouldn't it? maybe that's why everyone just says clock gets reset instead of just paused when it comes to RFIE and they say paused when it comes to RFE... Here, I am talking only about the people posting on this forum...

if it is within normal processing times according to them i don't think it would make too much of a difference, but as my dad always says, you wont know unless you try... it might speed things up or it might not but its not gonna slow things down... no harm in trying is what I'm trying to say lol...

Same here, 104 days, no RFE or RFIE and still no news. I sent a SR on June 15. June 22 they said they were working on it and that I might get news soon. I filed another SR last friday. As of today, it has not been assigned. 

Hope we get news soon !!!

hey... you r from buffalo too... you will probably end up getting the green card without the interview coz otherwise you should have gotten an interview date by now... hope u hear good news soon...
