That's why I asked - it seemed you were under the impression you could use the EAD to re-enter the US, when you can't. Usually people file for both AP and EAD at the same time and receive a single card that serves both purposes - I wonder if that's where you got confused?

 

When I filed for my AOS, USCIS lost my AP paperwork and I had to refile. Because of that, I received the simple EAD card and the AP as a paper. I had to go back to my country because of my kids (the ones we're now filing AOS for) and I used the AP to re-enter during our Christmas visit (they never asked for the EAD). By then, my greencard had already been approved, so when I had to leave after Christmas, I took it with me and just used that to re-enter in February. Never had any issues aside a little waiting period.

I'm curious, what are the next steps? Will there be radio silence (maybe online access at MyCase Status) until the biometrics appointment?

 

Then, I assume either the EAD or the letter for our interview will be sent next, is that right?

  • AP application received: 9/15/17

  • Interview Notice received: 12/23/17
  • AOS Interview: 1/23/18
  • Approval email/texts: 2/8/18
  • Green Card mailed (hopefully): 2/14/18

Pretty much. I didn't hear anything back until about two months after my biometrics appointment, and then my EAD was approved on the 15th of March.

03-19-2021: Officially an American Citizen 🇺🇸 Entire journey from initial K-1 Visa filing to Naturalization took 5 years, 8 days.

Text messages and emails were received on March 15th so I'm assuming that the letter will be here soon.

You are REQUIRED to have AP to re-enter the U.S., otherwise you ABANDON your currently processing I-485, AND your EAD becomes a useless piece of plastic. You would have to re-apply all over again with a CR-1/IR-1 visa, and that could take OVER A YEAR to process, just to simply come back.

 

Without AP, should you leave the United States, you can't come back. It's not a problem if you never leave, however. An EAD filed WITHOUT AP will explicitly say on the bottom of the EAD, "NOT VALID FOR REENTRY TO U.S.". See the attached example.

WITH THAT SAID... GOOD NEWS!

 

You can always file for AP after filing for I-485 and I-765, AS LONG AS YOU NEVER DEPARTED THE U.S., it will just be a paper document you will need to carry with you when you travel abroad. You would need BOTH your EAD as well as your Advance Parole paperwork for traveling abroad.

 

File anyways. Include a copy of the NOA I-797C you received for your filed I-485 so they will waive the fees as it is FREE with a filed I-485. If you do not have a reason to travel, on the application just simply state "To be determined", and you're done. You will receive a separate NOA1 for the AP when they receive it.

 

DO NOT TRAVEL ABROAD WITHOUT AP.

 

The moment you have your Green Card in hand, you no longer require AP.

I was really surprised that I could finally track my status. Didn't really expect that it would work.

I am new here. I will be following this discussion a lot. My petition was just sent on March 9th and I just found out our check was already cashed today, finally!

 

Anyway, this is a little off topic, may I know how you added your timeline on your signature line? I've been searching for it and they said I just need to edit profile, i did but there was no option there anymore, there might be a new way.

2017-03-23 - Received four notices - I-130 / I-485 / I-765 / I-131

2017-03-27 - Received email that they are sending an RFIE notice

2017-04-03 - Response to RFIE mailed out today

2017-04-05 - Response to RFIE was delivered to NBC, Lee's Summit, MO 

2017-04-07 - USCIS acknowledged receipt of the reply to RFIE

What does it say when you look up your case numbers? I keep checking the app but none of the petitions around me even show anything besides those who have received RFIE's. Just curious. 

And you should expect them sometime this week. It doesn't take too long after getting the email / text.

The emails and text messages you get contain your case numbers. And you can look them up online just like it was back then with the K-1. But recently a lot of peoples numbers don't show up online for quite a while.
