I sent our concurrent I-130 and I-145 packet using the new forms (with I-130A instead go G-325A etc) on Thursday, it will arrive in the lockbox today. I'll keep you all updated!

Same here. I'm going to give them a call on Monday so see if anything can be done.

 

I also looked like to check an app that shows me 250 cases before and after mine. None of them actually seem to work besides those who have received RFIE's.

Anyone doing their biometrics in San Francisco on the 30th? :)

 

I got my letter on Friday, so around the time many of you got it.

 

Can't check online yet either.

I just received my letter as well, for the 28th! 

 

It says on the letter, under case type, that it's for i485 and i765, do you know if my spouse has to be present for this appointment as well? I've read conflicting posts on this forum so i'm not sure

Only you need to be there. Make sure to bring photo ID's and the letter. And it's normal that it's only showing the I-485 and I-765 since the AP and EAD is a combo card, thus only mentioning two instead of three.

I did not apply for AP (since I am applying for EAD anyway)... but thanks for the info, that's really helpful! :D

Well uhm, I'm thinking I don't need to travel out of the country any time soon, and when the EAD arrives, I can just use that to gain entry into the US in the future should I leave. So that's why I didn't think it's necessary for me to apply for AP

You actually need to apply for AP if you want to leave the country and want to enter the US again. 

EAD is your document to accept work and that you are legally allowed to work. You CANNOT use your EAD as your travel permit. That's what the AP is for.

congratulations to all who have sent their package and those of us who have received their letter (I-797C) for biometrics appointment, I wish all of us the best of luck.

 

On the other hand our status on the USCIS website could not be updated yet, in my opinion and interactions it could be that they are still working on updating our status on the portal but I don't see that as a problem since we still get mail notifications and update from them.

 

For the EAD (which form I-797c) specified only biometrics for I-485 and I-765, these are the only once needed because  the EAD is a combo card and I think serve the dual purpose of the work authorization and advance parole for those that wish to travel out. As @TL2016 rightly said, it is only the beneficiary that is needed for the biometrics and don't forget the things needed to go with as specified in thee appointment letter. Finally I believe the AOS is adjudicated under three specifics and  that is why we receive three texts and emails, two out of which is covered in this biometrics appointment. Good luck to us all.

NO!

 

You are REQUIRED to have AP to re-enter the U.S., otherwise you ABANDON your currently processing I-485, AND your EAD becomes a useless piece of plastic. You would have to re-apply all over again with a CR-1/IR-1 visa, and that could take OVER A YEAR to process, just to simply come back.

 

Without AP, should you leave the United States, you can't come back. It's not a problem if you never leave, however. An EAD filed WITHOUT AP will explicitly say on the bottom of the EAD, "NOT VALID FOR REENTRY TO U.S.". See the attached example.

WITH THAT SAID... GOOD NEWS!

 

You can always file for AP after filing for I-485 and I-765, AS LONG AS YOU NEVER DEPARTED THE U.S., it will just be a paper document you will need to carry with you when you travel abroad. You would need BOTH your EAD as well as your Advance Parole paperwork for traveling abroad.

 

File anyways. Include a copy of the NOA I-797C you received for your filed I-485 so they will waive the fees as it is FREE with a filed I-485. If you do not have a reason to travel, on the application just simply state "To be determined", and you're done. You will receive a separate NOA1 for the AP when they receive it.

 

DO NOT TRAVEL ABROAD WITHOUT AP.

 

The moment you have your Green Card in hand, you no longer require AP.
