Not really. Today marks day 98 for me and I'm still waiting. Some people have been waiting 100+ days and they haven't heard anything from USCIS yet.

So not all EADs get approved around 90 days...

To be honest I think the idea is wrong and that Visa Journey is grouping the forum categories in a nonsensbile manner..

I'm still confused as to why there is a distinction since the title is AOS filers in a category of family since the AOS basis is family for all entry visa types.

 

The adjustment of status category for all of us is due to a USC or otherwise qualifying family member, regardless of entry visa, is it not?

 

The K visa is a non-immigrant visa and is not processed as an immigrant visa when you enter, you've got 90 days to marry the spouse who petitioned for you to gain eligibility for entry with dual intent;  and furthermore submit AOS on basis of USC spouse. I get that if you submit within the require period the required document sand processing is slightly different (e.g. if you wait too long you two will have to submit the i-130 as well as having already done the i-129 petition with your AOS app) . While that is a small distinction the adjustment of status category is still family which is why I'm confused as to why the focus of family is on the entry visa, since the entry visa has very little to do with it.

 

Given the way other areas of the forum are categorized, I'd expect that the type of AOS petition (based on family member petition here) would define the forum, not the entry visa?

They're separating everyone because the processes can vary slightly. K-1'ers can be approved without an interview. Almost all other visas require an interview in person. That's the major difference besides that those without a K-1 Visa also have to file form I-130. It seems like those with offices that have major backlogs are more likely to get interview waivers. At this point that's exactly what I'm hoping for. 

 

To clear the K-1 confusion up though: The K-1 Visa is a non-immigrant visa with immigration intent. Visas like the B1/2, F1, J1 and others are non-immigrant visas without immigration intent, since that's not what they're there for. But hey, love can happen anywhere and that's where the VJ sections come in.

Does USCIS update the application status on weekends too or only from Monday to Friday?

I am so excited and happy to finally have some news!

BTW I got a RFE in march the 16th about my birth certificate, so in my case it didn't affected for my EAD, my AP still shows the same message than before!

- the fact that USCIS is an unbiased umpire in adjudicating our cases and them and only them alone know the way and method they do that and the procedure they follow

- the essence of the classification of tourist/student etc here is just to help visajourney in their statistics which have helped most of us calculate how long it takes to adjust status and perhaps other threads aren't busy and detailed as these ones

- That USCIS do not have preferences in ways the treat or handle our cases and as such I humbly urge us here to share comments and suggestions that will alleviate the already frustrating and nerve wrecking process instead of asking "which visa you are adjusting from"

- I sincere appeal to all to encourage and not discourage others, it is not our duty to legitimize who should be here or not.

We all just need to remember we need to be here for each other. Remember the reason you signed up for visa journey in the first place, its to share your story and find people that are going through the same journey, I would also like to remind everyone that although yes this is a forum for K1 filers, the student, tourist, work based adjustment forums are either so small, with no alot of traffic, or non existent, we are here because we want to be a part of your community and our journey (apart from the waived interview most k1s have) is the same, so really it doesnt matter at this stage what we are adjusting from. 

Just be positive, and supportive of each other, thats all that we all want. :)

NOA I-130, I-485: March 27 2017
PD I-765: March 30 2017  #no AP
1st Bio notice:April 7th (I-485)
Received RFIE letter: April 8 (was abt my birthday certificate)
Send RFIE to Lee's summit : April 10
Response to USCIS for RFE was received: April 13
Bio done: April 17
April 24: Letter for I-693. A completed and signed I-693 was not submitted.. I must bring it to the interview

Actually USCIS DOES process a K1 visa as an immigrant visa. And I didn't file the AOS with in 90 days and do not need to file a I-130. It is a visa intent to stay in USA that's why it's processed that way. When you have a tourist visa or a work visa your intent is to stay for that amount of time that your visa allows you. It says that this section is AOS from a family based visa, so it's not your AOS that's family based but your visa. They are processed differently. SO someone who came to the US on a K1 visa is processed differently, we already had an interview and had to prove our relationship BEFORE we got the visa, that's why as a K1 visa holder you can get a waiver. This also makes timeliness different because it's processed different. 

I understand that this may not seem logical, fair or whatever. But that's just the way USCIS works, not necessarily VJ.

Thanks. The K-1 to my knowledge is not an immigrant visa, rather a dual intent visa, as many work visas is L, H etc..

This is really just splitting hairs I think.

 

Granted, there are differences with those that entered under K1 in most cases however I'm saying most of these differences do not warrant a separate forum as the journey is essentially the same. Additionally, what I find annoying is the labeling. Family based AOS covers all of the variations we are discussing, so if there really should be a distinction it should be less ambiguous.

 

I feel like the forums should be split by AOS category, e.g. C9 as that grouping would group similar experiences.
