I knew there was a possibility this was what my RFIE was gona be for, because I only read about sending in pay stubs after I sent off my application. But we sent in all his tax stuff! :) 

but that's good to know about the finicial aid, because neither of us were aware that didn't count as income, don't really quite understand why.

Long story short, I sent out my AOS package on 4/22, and it was delivered on 4/24. I received a text and an email notice with a receipt number yesterday, so I thought everything would be fine even though I only got 1 notification with 1 receipt number. This morning, I got this I-797C Rejection Notice in the mail along with I-485, I-765 and I-131. So, it means they only accepted my I-130. Based on what I've read on the notice, it seems to be they went through my I-485 before my I-130 was approved. Therefore, they could not find any of my I-130 approval on file. I will wait for the official Notice Receipt of the I-130 to be arrived, and I'll mail out the returned package again along with a copy of the approval notice. 

 

Is that all I have to do according to what they said on the notice? Is there anything else that I need to include? Is it normal when it happens to me since I've seen no one got such a problem filing I-485 and I-130 concurrently?

From my understanding loans that are to be paid back can't be taxed like income nor grants. Like you I also did not send in my pay stubs for the AOS. I have not heard anything yet just playing the waiting game. I only sent in tax transcripts.

@Pinkielicious this is so sad and horrible, I wish I am versed in this, please guys who knows more about this situation should share with us to learn. Just hang in there and try to gather all they need to respond as soon as possible. Keep it positive and good luck.

@emchappie it is sad that you got this but if it is possible for you guys, you may have to consider a joint sponsor, I feel it doesn't hurt if you can get one so as to send the package back as soon as possible. Good luck

Thank you, @atuegwu! I'm gonna wait for the official notice of the I-130 and send the whole thing back to them. Do you think I should attach a new check? They stapled the check on the rejection notice, and there is a stamp of U.S. Department of Homeland Security on it. I don't know if I should leave the whole package like that and resubmit or I should unstaple the check and put in the new one.

That actually makes ALOT of sense, id never thought of it that way of them seeing it as a loan! I feel like that's super obvious too! you might get lucky and they may not ask you for it, but in my RFIE, it said that we hadn't provided significant evidence to prove his earned income. So get the pay stubs ready and then you can just send it right back :)

I mean I explained in the first post that my husbands actually got a new job - and before we were using his school money and income to be above the poverty guideline, now with his new salary we don't need to use (not that they accept it) his school money. But it's just a case of whether they will allow us to use evidence of his new job as he has only been there a month. 

Honestly if I get a joint sponsor it will just take way longer than I would like to get the RFIE sent back because there is so much evidence to gather from them and I don't want to spend all of my time chasing them around so I'd really rather not get a joint sponsor.

@Pinkielicious it is okay and in my opinion, leave the package the way it is especially the check but do well to go through the applications to make sure all the Is are dotted and the Ts crossed. Good luck and stay strong.

@emchappie okay, I now understand, I feel you include the new job's and old job's pay stubs and employment letter, attach a letter if possible explaining the details of the new job and the benefits included in it, with that I think they will accept and consider him as your sole sponsor. It is obviously full of rigors getting a co-op not. Good luck.

Yeah its a slightly more complicated situation. We were gona ring this morning to double check and make sure we didn't need to include anything else, but it was virtually impossible to get through on a Monday morning as everyone is trying to ring to sort their problems out. So gona try tomorrow. I would have been fine with getting a joint sponsor, but it just isn't a lot of time to be able to get all the stuff from someone else, and I just don't want to be spending all my time running around after someone else to make sure I can get this sent in on time. :) 

fingers crossed that the new job employment letter will be enough proof of the new job.

Hey guys, another week just started, hope everything goes well for everyone!

I sent back my bio request on may 4th since it was lost and I still haven't heard anything yet. Last wednesday I called USCIS trying to know when is my bio appointment, and they said an officer would call me back within 3-5 days. Today I called back again and they told me to wait until June 4th. My schedules are really tight for the rest of this month and beginning of June, and they said they just could not tell me when is my bio appointment.  So have you ever tried to talk to an officer and how did you request it? Thank you!!!!

Got wife's RFIE letter in mail today and it is for my I-864. I am couple thousands short, so I am getting another co-sponsor I-864.

So now my question is how do I submit this properly. On my I-864 I had "1.a I am the petitioner. I filed or am filing for the immigration of my relative.", so does my co-sponsor select "1.2. I am the only joint sponsor."?

In this case, is my I-864 even considered since it does not meet the income requirement?

 

Please spare me from the comments asking why I didnt get co-sponsor sooner :(
