USCIS may expedite a petition or application if it meets one or more of the following criteria:

  • Severe financial loss to company or person;
  • Emergency situation;
  • Humanitarian reasons;
  • Nonprofit organization whose request is in furtherance of the cultural and social interests of the United States;
  • Department of Defense or national interest situation (These particular expedite requests must come from an official U.S. government entity and state that delay will be detrimental to the government.);
  • USCIS error; or
  • Compelling interest of USCIS.

I think that sounds like good reasons for them to expedite your EAD. Fingers crossed that you will get it but I personally think your chances are good. USCIS usually decideds in favor for the people if it has a charity aspect and a nonprofit is involved. 

 

Ive been in a similar situation before on a B1 visa and tried to extend it with the reason being that the Nonprofit would lose her only employee with Marketing and event experience and that shortly before their biggest fundraiser event of the year. The organisation gave me a letter explaining that when I submitted my application for the B1 visa extension. I was told on VJ that my chances of getting this approved are close to 0 and that they don't know of anyone who ever got a B1 visa extension approved. I got it approved with no problem! I was pretty surprised (so was everyone on VJ cause they said that was impossible) but reading the reasons for the EAD expedite about nonprofits I am actually not surprised at all anymore.

I personally think you should get the RFE any day right now though (assuming that you get one). We'll see what's faster, the RFE or your the documents you sent today :)

Ohhh!!! It is different from RFE but all the same take it easy and re-gather your documents and it's supporting documents so as to send out immediately the mails arrive. Have someone else help you double check. It is good it comes now than when you have spent months waiting for useful response. Stay positive and good luck.

You did well sending them out immediately and that it came this early rather than months after you send your package. 

On the other hand I don't really know the criteria the use in expediting cases but let's hope and pray it goes through pretty soon and good. Don't panic, be strong and positive. Good luck.

Hello friends, it's been a great week and journey for us all despite some downtime on some of our mates' status but all the same, we all have to keep going believing in the best.

I just want this day to be over. Seriously...I have forgotten to submit two pictures for my EAD and two for my AP. Happens when you don't read the instructions completely. SO done with this day.

This might (but not always does!) turn your waiting time back so zero because it's an RFIE and not RFE. Don't get immediately scared that others say it definitely turns your time back to 0 because there's been plenty of VJ members who had RFIEs and their timeline wasn't significantly different than others who didn't get one. Also since you got the RFIE so early it likely won't affect your application at all because USCIS doesn't usually start processing your application anyways until they have your biometrics and you haven't even had it yet.

To 99% it's something about the I-864. People always do something wrong with it or didn't send all required documents. Check it again whether it is correct. 

 

Also as I said before in a post for someone else, if you haven't had your biometrics yet I wouldn't worry about it too much. They don't start processing your application anyways before they didn't get the biometrics.
