its so hard when you have something to be there for isn't it.  
I contacted NVC this evening and spoke to a representative who was kind but very scripted.  I politely mentioned that my documents were scanned by them on 31st Jan and that when I made an enquiry a while ago I received a reply on 17th feb advising me to allow them 6 weeks to review my documents.  I politely mentioned that its now 7 weeks and I was calling to check the status of my fie. 
He confirmed that they indeed have not started reviewing my documents (I wanted to cry then and there) and that as of yesterday the processing time has extended to 11 weeks.  I asked about speaking to a supervisor and politely explained my situation. He told me speaking with a supervisor won't help at this stage and that they have been advised to give the same information.

So here I am at 7 weeks at NVC, and meant to be in the USA in 7 weeks time.   I'm really not sure what else I can do at this point to speed things along.

I have an expedite for the interview so once NVC is done with my file I could be interviewed in as little as 3 weeks.  But if not, then my hubby goes ahead of me, and I'm here without a job and moving countries with a baby on my own :-(   Praying for a miracle.

  2. & you actually being a non-resident alien have already filed your taxes in US; which you haven't yet.

Glad to be of help.

If our situation is the same, then you can also go for the route that we selected. It accomplishes following

        - It lets you(your husband in this instance) file your taxes as "married" as oppose to "single"

        - It reduces waiting time and all the hassles (getting ITIN, requesting for late tax filing with IRS etc)

        - You will have your 2016 tax return ready at the time of interview (or possibly when you're sending AOS package to NVC) so they will not have grounds for delay/checklist/ rejection based on unavailability of your latest tax returns

 

Good luck with whatever route you end up taking.

thank you.  Yes I am praying and having faith.  We thought we'd be through this process when my little one was 6 months old, she's now 8 months old and we had to get an additional visa for my husband for here in NZ in the meantime.  Gods timing is not always understood, but I pray we are at least on the same page and that he knows our heart :-)

She filed as "married filing separately" because of the reason that you already mentioned (we did not want to wait for ITIN). As we chose the option for filing as "Married filing separately", we did not need to include information about my income. We will include that when we amend her 2016 return after I go there and have my SSN. By that time, I will also have filed my taxes.

 

My wife and I, both were working when she filed her taxes last month as "married filing separately" which we included in our AOS package.

 

I hope this answers your inquiry. Please point out if I missed any of your questions and also feel free to ask if there are any further queries you may have after reading this.

 

PS: just to be sure, "married filing separately" is still you (or your spouse) filing as "married". So, if you're worried about CO having queries regarding genuineness of your relationship, that is a false fear.

My husband has filed for an extension and would furnish 4868 as proof for the most recent tax year - 2016. After I have my returns filed in India; he would file his "Married filing jointly" with my application for ITIN.

 

Also, it states on travel.state.gov that we can as well submit a copy of 4868 as proof for most recent tax year with 2016's W2. So going ahead with it!

 

I am sure it will work because it is stated on the website. :) Thanks for all the information that you shared.

the first one worked for me. Make sure to put both your AOS and IV packages in the one mail.  For example one envelope or folder for AOS, one for IV package ...then put them both in the one big envelope.

@Thesmiths2016 we are in the same boat. I booked my ticket to see my wife for early may and coming back in mid june assuming 6 or 8 weeks but this 11 weeks messed up our plan to come together. Praying for you as well as for me for miracles. stay strong and don't stress yourself. stay happy that you guys are going to be together very soon for the rest of your lives.

07/25/2019: Bio-metric completed

09/19/2019: Interview, Case Approved

09/26/2019: Green Card received 😀
