I do not think this is correct. You have to go through the address change process with USCIS. Then, you will need to satisfy the 3 month residency clause at your new state which is difficult to do since you don't have control over your interview date. People have been rejected for moving and not satisfying the 3 month clause at interview date. That's disappointing :( , but that's something to consider. People on the website you are referring to say it is a district policy. I wonder how applicants can figure out each district's take on this. More research to be done, I guess.

I would suggest that you postpone your move until the interview and the oath to be on the safe side.. You don't want to mess up your naturalization.

I'm with iamwhatiam...

If possible, postpone the move till you become a citizen. If you absolutely must move, be honest about it at the interview and try to make sure you're getting the best advice before going in. If you move and are successful with naturalization from your current application it may make you eligible for denaturalization down the line (even if you were honest about it). A case review may find that you did not meet residency requirements and therefore was not eligible for naturalization. Denaturalization is retroactive. That would mean you were never a citizen which also means if you filed for anyone based on your citizenship they will lose all immigration benefit (green card etc) if you were denaturalized.

 

Don't go through the process now and lose sleep later.

Thank you! I definitely will try to keep the process as straightforward as I can. If need be I will just delay my move. At this time it is just a vague perspective. Hopefully, by the time I need to make a decision I will be through with naturalization.

So I showed up today to show the old stamped FP letter and the new one and asked to speak to a supervisor. She told me that the old notice was a code 3, while this one is a code 5 and that code 5 means that they just check the right hand to see if they already have the FPs in the system and then let me go. Turns out, the FPs are already in the system and so they just re-took my pic and my signature and let me go. This whole thing gets more  and more confusing. I read in another forum someone else got this second "code 5" notice, and was also a very recent post from 8/5. Is this a new thing? Frustration keeps mounting...

Going to a lawyer next week, none of the stuff I'm hearing makes any sense and need professional assistance. Hopefully it won't be a waste of $.

I dont think a lawyer would be of much help. But it does not hurt to get an initial consultation.

Maybe now the system will move your case forward because there will be some action taken after this second FP appointment. It probably was stuck in some weird limbo state and now things will hopefully start moving for you.

What worries me is that every L2 officer I spoke to told me a different story. Should be as easy as looking up the case info on the screen and telling me what is says but apparently it isn't. The last thing I heard is that my original FP appointment was cancelled, which is complete bs since I did show up and have a stamped receipt to prove it. That's why I'm going to try the lawyer route.

I agree that the move may make the process more complicated and could be a cause of a lot of delay. However, the cases identified on the other website submitted their application before meeting the residency requirement or had issues with living and working in two different states. In your case, I am assuming that you met the residency requirement at the time of filing. The USCIS website provides guidance as follows:

 

"In general, an applicant for naturalization must file his or her application for naturalization with the State or Service District that has jurisdiction over his or her place of residence. The applicant must have resided in that location for at least three months prior to filing."

 

"In cases where an applicant changes or plans to change his or her residence after filing the naturalization application, the applicant is required to report the change of address to USCIS so that the applicant’s A-file (with application) can be transferred to the appropriate office having jurisdiction over the applicant’s new place of residence."

As I pointed out in my earlier post, read POST #20 in that website (http://www.trackitt.com/usa-discussion-forums/n400/644922829/denial-for-lack-of-3-month-residence-requirement). Case was rejected because residency clause was not met within 3 months from interview date, not 3 months from application date.

Sorry I missed that one. It is very unfortunate when the policies are not followed as written. In the end it is the applicants who suffer. :(

Just the fact that USCIS makes a decision does not make it right.  This could be reversed in a court. But the truth is, if one can do anything to avoid unnecessary complications it is better to do it.
