I'm literally going through a similar situation, except I immigrated to be with my wife in the states. Everytime I try and breakup with her she threatens to kick me to the curve and destroy my property. I've spoken to a lawyer and they suggest I follow through with the process but how can I trust it will ever happen it's already been eight years of litterally wasting career opportunities and missing watching my younger cousins and nephew growing up. The entire time I've had to help support and endure her sister and her kids who aren't able to look after themselves for some reason. So basically people who get into a bad situation like this are SOL or what?

March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

What visa did you come in on?

Have you ever received your green card? Your status says you're waiting for AOS, but you also say you've been dealing with this for eight years.


If you want to leave your wife, then leave your wife, her kicking you to the curb would be part of leaving her. If she destroys your property, then sue her for damages, or simply take the stuff first and then serve divorce papers.

Now if you want to stay in the US and you're still awaiting AOS, you won't have a path into the US without her. If you're at least doing removal of conditions, you could be able to stay with a divorce waiver but I don't know what your status in the country is.
If you're on a 10 year green card, then just divorce her.

Sounds like he came on his WVP and got married..

 

so you overstayed your visitor visa, and you got married and you filed no paperwork.. unfortunately, she has all the power! you need to file AOS immediately or once you leave you will incur a 10yr ban and getting a tourist visa to the USA in the future will be almost impossible...

 

many USC threaten to send the spouse back.. this is normal.. its unfair and defintely verbal abuse.. but i really suggst you try to work it out!  i also think your spouse doesnt hate you but maybe wants attention or for you to pay more attention ect.. 

 

this really is very similar to a normal couple fight except instead of someone saying 'im going to throw u out of the house' the spouse says 'im going to throw you out of the country' lol neither spouse can do either! haha! 

 

get your greencard also so u can work.. that should help:)

Why not just go back to your country? I mean, if you never applied for AoS and you don't have a green card or a job, then there is nothing keeping you here. Except the miserable relationship.

Sorry, she is not a good person. Just because you are a foreigner she shouldn't trhow you out as you were an old suitcase, you are a human being. Sorry

Yes, I agree, it's possible, maybe she is very angry at him because something yet it could be still love present and maybe all fixed. The new immigrant depending in all for us, USCs is very sensitive and easy to hurt but also we, USCs are confused and frequently hurt reacting in a strong way. They both need to calm down, try to respect each other, maybe the marriage stays or maybe not but anyway trying to do better.

Not easy at all, many mixed marriages fail and many regret about it afterwards because usually both parts come to each other with a genuine desire to build a family but so many differences yet throwing the person out should be the last one thing to do, maybe in case of abuse and danger but not playing with the foreign spouse dependence
