Adopt Step-Child

Hi! I hope someone can help me out:)

 

i petitioned my step daughter (IR2) and she arrived today! Yey! And I would like to adopt her, my wife and the biological father wasn't married before but my step daughter is acknowldge by the dad. Do you know any ways I can adopt her? Do we need to get a consent from the dad? Although the dad was the one she was with on the Immigration Interview and he made an authorization letter regarding my stepdaughter coming here to the US. The biological father is residing in the Philippines.

Is this for immigration purposes? If so, I would think that there is no need for adoption. She is already a permanent resident and by the time the adoption process is completed your wife and stepchild may be eligible to naturalize. If it is for personal reasons you may find better help in an adoption forum or, even better, an attorney who specializes in this field.

 

I would like to mention that if the biological father is still in the picture, you potentially adopting his daughter should have been a topic of discussing prior to her immigrating. Giving permission for a child to immigrate to another country is one thing but giving a child up for adoption is another. One consent doesn't give permission to the other. And it seems that you would need his permission from the noncustodial parent to move forward with the process.
