3-year or 5-year path for N-400

Hi Everybody,

 

My spouse is in the process of filling up N-400 form.  He came here with a fiance visa.  We have been married for 5.5 years, and he has the green card for 5 years this March.  What is the best path to take? What would he answer on the number 1 question:  lawful resident for at least 5 years OR lawful resident for 3 years and been married and living with the same US citizen spouse?

Then I would go with the 5 year! Much less evidence and so on needed. Good luck.

As long as she is eligible under both categories, go with 5 year rule.

Agree with the above posters, I would go with the 5 year rule. Although you and your husband are married, he can now get citizenship based on his own merit of being a PR for 5+ years. A lot less evidence to have to send in with your application and he can answer 5 years for question 1.
