I am really sorry that you and your family have to go through this, I can't even begin to imagine the heartache. and I do hope you resolve it. 

But if it does come down to that and you need to come live in Mexico and need any information, advice, help with whatever just send me a message through here.  I currently live in Mexico City but I move around and live in different parts of the country for a few months, including Cozumel and Guadalajara. 

I know it's awful to have to take responsibility for something that happened so long ago and it kind of comes to bite us in the butt. I find myself wanting to go back in time and make better choices, since all we do creates a ripple effect and affect our future, but alas, we can't. The best we can do is remain strong and hopeful, work hard and try to do the best out of a bad situation.

I do not know how they get their Mexican Passports but the OP has been in contact with the Consulate so they should be able to advise.

I didn't read any other comments. 

 

Go on over to immigrate2us.net, that forum deals with immigration ####### storms like you guys situation. I've been there before also, and as much as I love VJ the folks on here tend to not have experience or dealings with removal orders as much as i2u forum goers. 

 

Now all that being said. Right now he has no right to relief. You guys aren't married. He hasn't accrued 10yr presence in the country to ask for cancellation. Why? Because he came back after signing what's basically an expedited removal order. That paper he signed waived his right to a day in court, he basically pled guilty to whatever removable charge (yes, it is called a charge) they listed on his forms and was sent back. That choice he made to return undocumented and he got caught again means he has a lifetime bar eligible for a hardship waiver after 10yr go by. There may be some other hardship options out there but I'm no lawyer so I wouldn't know fine details. 

 

The best you could possibly do is get a stay for another master calendar hearing. You and him ask the judge for a stay because you don't have a lawyer and most of the time that will get a little time to work on things. Go to the building that he will have court in tomorrow, go tomorrow and speak to the pro bono advocate and she or he will give you a list of pro and low bono local immigration lawyers. I've seen this happen before when we went to terminate my husband's removal. You just have to come forward and ask. 

 

In the off chance that they offer to release him on a 220-b check in order, start getting some bond money ready. Usually 5000$, but with his history it'####### and miss if he would be offered bond or just held if he got pended. 

 

I suggest you not get ahead of yourself and worry firstly over if he can be bonded out or gotten a stay for another master hearing so you can work on getting married somehow and create a right to relief. If those are a no, then you can think of possibly moving to Mexico with him and the kiddos.

Sounds like he doesn't have any type of ID, so they couldn't apply for a marriage license and he couldn't sign the birth certificates. At least that's what I read.

He should have been able to get a Mexican passport to use as ID, so not sure why that didn't happen...

He has no relief right now or even rights to see a judge.

If he was not convicted  (could have=reason to believe clause) by uscis

Reentry can have some given 20 years fed time

This is a lifetime bar that will need a great lawyer.

The current Admin cares nothing about ones personal plights.

He will get an expedited deportation now,

He should stay out, there might be new changes in 4 years

Try border living

You are correct on your comment. He never had his acta,matricula,credincial etc Thats why the marriage or the signing of the birth certificates never happened. Yes a passport would have sufficed except he couldn't get a passport without the above mentioned papers.

First off thanks for the helpful information/tips. After speaking with his immigration officer he said that he does have a chance at getting a master calendar hearing BUT it can only be done and processed correctly with an attorneys guidance due to strict laws and loop holes. I will definitely be checking out the other page you mentioned thanks for that. I stumbled across this page/forum by doing an internet search for support groups,chats or forums on this topic. It is really hard for my family to understand my situation without them having ever experienced anything like this. I have read about 3 different forms that might be able to assist him I don't know for sure just what i have read net wise and on uscis' page. The I-601,I-212 and one other that slips my mind at the moment. I am not saying we have a hope in this matter I just have to try. Of course I expected people to bash us for our decision in all this and I am by no means saying we don't have fault in this. We should have taken care of it all before now we just got busy living life like normal people working and watching our children grow. I honestly know that if he has any chance it is very small so in saying that I have taken it upon myself to make preparations for us to go to mexico if needed. I just can not for the sake of my children give up trying. I still have not explained to my children where daddy is. They know that he does go out of town at times for work so I put it off on that and when he calls they speak to him. I have yet to formally inform his family only one of my sister in law knows due to my mother in law being ill and the last time I remember clearly she got very sick and depressed and stopped eating. We just don't want to lose her over this. I am no lawyer though times like this I wish I was. Hopefully the good we have shown to other people and our community we will receive a good amount of answered prayer/blessings and good karma.:)

I appreciate all your kind words. Even though it is just words it speaks mountains in situations like this when I am alone. Based on the situation I know he doesn't have much of a chance so I am trying to do as much research as I can at the moment which is mostly information from my sister in law and her husband. IF we did have to go to mexico we would be going to the tuxla area more then likely being he is original from chiapas but his sister lives in tuxtla and says that it has grown "more american like" in the years since his absence. Everything he remembers of mexico she says it isn't like that anymore. I am not honestly worried about myself because I can adapt to any situation as long as we are together. I worry for my children for example they don't speak Spanish even though I told my husband he needed to work with them many times. My sister in law tells me that tuxtla does have a lot of the stores we have here so kids should be able to adjust life wise.My main concerns is again their language barrier and schooling. Schooling is number one importance in my book. I just want my children to continue their education and not have to struggle paycheck to paycheck as we do. I also need to find of course some land etc for us because we had some in comalapa but father in law needed some cash and he asked for permission to sell them so we will be starting fresh in it all. Any advice or tips would be greatly appreciated. Maybe I did not explain it propelry, he could have secured documentation in the US, the Mexican Consulate and well versed with dealing with such issues.

O I understand maybe they don't know that. We tried asking them and they said they could only help him get his passport once he had his official documents proving he was him. Not sure unless things have changed since we last called.

Mexico has certainly changed a lot. Tuxtla Gutierrez is not bad at all, it is Chiapa's capital and biggest city, so it's definitely very modern, has a lot of options and stores. It's definitely not the same as the U.s but it isn't what many people think either. I've been to Chiapas before but just to Palenque, I've seen the cascadas de agua azul (gorgeous!) and San Cristobal.

IMO, anyone who would bash you is fairly heartless. Life happens and we don't always make the smartest choices either. You're looking at someone who did similar, we waited to file AOS and my husband ended up in removal. Granted we were married but it was still very scary. It felt very hopeless at the time but I can tell you that 2.5yr later we are finally going for his AOS interview. You can always PM me if you need someone to talk to about this. On I2U, you will find Laurel Scott's chat logs, she is the waiver queen (601 and 212), it is all she does and she hosts a weekly live chat to answer questions. You can find the listing for her live chat site and logs of the chats for the past year on I2U. 

 

Also, you may use your local congressional representative to see what help they can do for him. We went to ours when my husband was in removal, they deal more with people who are detained than on release, but believe me there is a caseworker in every office who does just this alone. Get working on a lawyer, I2U also has a subforum listing tried and true lawyers who forum members have used. 

 

Don't give up hope just yet, but also ask your lawyer to be 200% real with you on what the outcomes could be. Also, go to the Mexican consulate on his behalf and ask for their help. I believe they can at least get his documents and such and possibly visit him in detention to assist him in getting them, and may be able to assist you two in marrying.
