Nope.

I think it takes about 2 years for the green card holder to file for the spouse.

As the spouse of an LPR, you are looking at about 18-24 months for a visa to become available.

 

She would need to file an I-130 for you, and once approved, you will get a Priority Date (PD). Then you need to watch for when your PD becomes current via the monthly visa bulletins. Technically they should contact you when it's ready, but you don't want to rely on them so you should be watching too.

 

While this isn't what you asked, you should also ensure to have more face time during the wait. Nigeria is a very high fraud country so they tend to be very strict. Plenty of face time and front/side loading evidence will help make your case and increase the chances for approval.

Once the I-130 is approved, you will get a NOA2 and a "Priority Date". It's like your spot in a line. Visas for the spouse of an LPR (your wife) are limited per year, so there is no visa available at the time of your NOA2. You need to wait until a visa becomes available. The monthly visa bulletin lists which priority dates have visas available. When your priority date is current (has a visa available), you can proceed with applying for the visa with NVC.

There are some mobile apps that send alerts anytime a new bulletin is released. Otherwise, just check once a month.

 

If you already submitted the I-130 (you said you had a NOA1, so I'm assuming you did), then you can't front load anymore. But you can provide additional relationship evidence (past and ongoing) while you are waiting for the priority date to become current. Nigeria's embassy is strict and many times the COs make their decision about whether or not to issue the visa before the actual interview. Providing lots of relationship evidence beforehand means they can review it before the interview, which should increase the chances of approval. And additional face-to-face time with your spouse helps as well.

ok

 well we just sent the i-130 in last week and the lawyer said it could take 2weeks before we get the NOA1.

well i and my wife intend meeting for vacation outside Nigeria. do u think additional prove will be accepted after submission of i-130, we submitted lots of pictures from 4years ago before she moved to the USA and wedding pics traditional and court pictures.

chat, skype screen shot and whats app chat history for 3 years.

i would appreciate if u send me mobile apps that i can download and also what u feel can boost our chances for prompt approval

 

i miss her already our marriage is barely one month plus

That sounds about right. It could take over 3 weeks, actually. They're still backed up a bit from the holidays.

 

Sure, sending the past photos are good. I would suggest getting a bunch of photos (from various dates) when meet again. Then send that as well. It's a good sign that the relationship is active.  Same with the chats/skypes/etc. Since you've been in a relationship for 4+ years, that should definitely help.

 

I'm not sure what kind of phone you have, but the main app I use is called "Case Tracker & Searcher". It gives me alerts when my case is updated, or whenever a new visa bulletin is available.

hello. quite a while i heard from u.hope u are good . my wife got the notification of action. priority date 27th feb. 2017. my name and date of birth was written  on it too.

it says aslso that a valid G-28 was not received with your case. if you wish to b represented by ur attorney or accredited repesentaive submit a follow up G-28 to the USCIS where your case is pending.

my question 1.  we are using an immigration lawyer. y are we being asked again for attorney?

                     2. why was a copy of this notification not sent to the lawyer?

                     3. hope this will not count against the time of the NOA2?

Okay, sounds like everything is in motion now. :)

 

It sounds like Part 8 was either not filled in or checkbox 7.b. was not marked, OR a G-28 was not sent with your application. Who completed the I-130...you or your attorney? If you did it (even with a lawyer's input and review), then this is correct.

 

If the lawyer did it, then Part 8 should have been filled it and a G-28 sent with the packet:

"NOTE: If you are an attorney or accredited representative whose representation extends beyond preparation of this petition, you may be obliged to submit a completed Form G-28, Notice of Entry of Appearance as Attorney or Accredited Representative, with this petition."

 

That would also be why the lawyer didn't get a copy of it. You can send in a completed G-28 to rectify the issue and have your attorney recognized as representing you. Otherwise, they can still give you advice but they cannot act on your behalf. That said, this is something the attorney should have pointed out, and most of the information he needs to complete anyway. You both must sign the form.

 

This shouldn't impact your processing. It only affects the ability of your attorney to represent you with USCIS matters for the petition until the G-28 is sent in.
