Well you said  maybe so I thought I'd extra confirm what you said lol! Yeah, it shouldn't be required <_<

Yes.. maybe, cause it's happened, not alot but I've seen several. I'd rather they, and others who read this, know that so they so they can plan accordingly depending on how cautious one wants to be :)

Good Morning,

Today I got a RFE letter from USCIS asking us to submit all supporting tax documentation (W-2s, 1099s, Form 2555, and all supporting tax schedules) for the most recent tax year.

It also indicated that my sponsor's (wife) income did not meet 125% poverty guidelines!

To make it clear, at the time we filed our AOS application we didn't have Tax returns for this year (2016), so we sent Tax returns from last year (2015) - those forms showed that she only made 12000$ a year because she worked 6 months by the time she had to file for taxes. The new taxes will show that she makes 26000$ a year ( we are waiting for IRS to mail them )

Since we  only have W-2s, I would like to know:

Do we have to file for 1099, Form 2555, and tax schedules? or they are included in the forms we get from the IRS?

and more importantly I would like to know if we should send Tax returns and wait for their answer about meeting 125% poverty guidelines? or should we start looking for a co-sponsor?

USCIS gave 87 days to submit the evidence requested.

Just get a co-sponsor because $26k isn't enough either. They will still send you a second RFE asking you to get a joint sponsor.

No they do not need a co sponsor. $20,025. is what the main sponsor should earn in order to meet the poverty guideline of 125%. Therefore, OP does not need another sponsor.

Do your research before you give advice, please.

Hey how are you? I hope you can see this message. Since it's been over a year I wanted to ask you how did it go? Based on your income did you get the GC? Looking forward to hear back. Thank you.

Sincerely,

Amanda

Hello. I was able to sponsor him and we got married in December 2016. I attached all my pay stubs from my second job and they accepted that in lieu of a full tax return.

We are now waiting the three years so he can apply to get citizenship. :)

Wow that's amazing God bless you guys I'm very happy for you.

I have one more question. What was your income for the most recent three years, by the time you applied? Do they focus on all three years or just the most recent one? What is form 2555? Does everyone have that?

When I applied, I had that 12000 only, plus my 26k return and my pay stubs (so I only had 1 1/2 years employment history, it was my first taxable job).

They focus on the current year's income, but your previous years show a good employment history and consistent income. Sometimes they ask for bank statements, like when you're a private contractor.

I'm sorry, I don't know what form 2555 is.

After you send back the Request for Evidence when did you hear back from them? How long it took the whole process? How did it go your interview? Thank you for being patient with me.

Did you succesfully adjust status? Don’t forget to remove conditions 90 days before his conditional green card expires. After that, citizenship can be obtained!
