HI guys, 

 

I am filling I130 to petition my husband. On part C question 15, it asks, "name and address of present employer." also "date this employment began" 

 

My question is about the date. My husband started working for his company after he graduated from college. Sadly, he didn't get selected in the H1B lottery for three times. So when his undergraduates OPT ended. As a result, the company has to terminate his work for about 5 months. When he went back to graduate school for his master degree, he was rehired back to the company and worked part-time on CPT during school years and full-time CPT during summer breaks. When he graduated from his masters, he changed from part-time CPT to full-time OPT again.  

 

So basically, he has been with the same company since Oct 2013. But he was terminated two times because there's some time gap between his eligible working period. His most recent rehire date is 5/2016. 

 

So should I put Oct 2013 as his "date this employment began" or should I put 5/2016? 

If I put Oct 2013, do I have to explain why there's two time gaps for his employment? I have his employment verification letter, where HR has listed his detailed hiring timeline, hiring work status (CPT, OPT..) and his current salary. 

 

Is that necessary for me to include that letter in my I130 supplement? 

 

I am just not sure how serious will the immigration officer think about this question on the petitioner's I130. To me, it looks like a minor question. I don't want to include the employment letter to create further confusion. We are filling I130 and I485 concurrently, and in his I7485 suppliement, we are going to send all his visas, I20, EADs cards to prove his legal stay and legal working status. 

 

I would really appreciate your help to answer my question.
