you're absolutely right......its very disheartening. I do wanna mention though that you shouldn't expect those time lines to be what you'll experience. My advice would be to be PREPARED for 2 months following Montreal getting the file and the interview because it could happen , however, mentally prepare yourself for 6 months. We used the timelines as our basis for expectation and were severely disappointed.......like being sucker punched.

I think we'll prepare for the worst and hopefully be pleasantly surprised when it moves more quickly.

I never would have dreamed that this process was so technically difficult. That is...until it was MY LIFE. Just want to make sure we handle everything properly and honestly.

I think for most Can/ Am couples , having to go through the same process as everyone else seems weird. We live side by side , share an open border.....most of us have traveled freely back and forth for a good part of our lives. Then we find out HEY you gotta get in line like everyone else.......then our line is 10 times slower.

You're kidding!?

Was the misfiling something that you yourself may not have done?

That had to be awful. It's exactly that kind of thing that scares me to death...whether we do it ourselves, or hire someone! The wait time will be long enough with NO setbacks.

so have you made a decision on what way you're going to go, k-1 or k-3?

.......or have you even considered going just straight CR-1?

You could potentially have a greencard within 4 or 5 months after approval of the I-130......no aos...no ead ......no ap....

with wait times at Montreal being what they are of late , it's something to consider. when we started we didnt even know a straight CR-1 (greencard) was an option.

Didn't know there was an option of the CR-1...PLEASE EXPLAIN if you will! Much appreciated in advance!

Otherwise we decided on the K-1 I believe, just because it looks a lil bit faster I guess.

well........first you need to get married as CR-1 is a spousal visa.

the CR-1 requires that you file an I-130 petition. Upon it's approval it would be sent to the NVC where it will be processed. Once the NVC process is complete it would be sent to Montreal for an interview. The entire process if you're on the ball and the USCIS part goes smoothly and quickly could realistically from filing to visa take 9 months.......but then you're done for a bit. Your future husband could work immediately, travel immediately.......no further forms , no further filing......until its time to apply to lift conditions 2 years later.

the average time for the I-130 to be approved at the USCIS is 4 months

looking at specific timelines for the NVC process and assuming they used all the shortcuts , that process can be as short as 2 -3 months.

After completion at the NVC up to another 2 months for an interview.

many are waiting 4- 6 months just for the Montreal process to complete for k-1's and k-3's (Currently, we are yet to see any December received files be scheduled for interviews), add that to the USCIS time and the wait comes out about the same. After all of that you have the AOS wait, potential namecheck hell ,AP (k-1) and EAD....blah blah .....

In hindsight I wish we would have known. At the time k-3's were supposed to be the quickest bet but I dont think that's the case right now. Montreal is still promising hope of 4 months max for an interview, depending on when you contact them and who responds.

anyway .......that's my version of an explanation. :)
