Hi Folks,

I'm k1 visa holder my POE was on Nov 24, my marriage was Dec 30. On Jan 11, 2017 I applied for my SSN, 6 weeks later I haven't received my card yet.

However my I-94 expired on Feb 21, 2017. This morning the Social Security Office contact me over the phone saying they can't proceed with my aplication because my SSN would be already expired, as my I-94 is expired. On Feb 16, 2017 my adjustment of status (EAD, AP. AOS) paperwork was received my USCIS, but I haven't been notified yet by them.

My question is: My husband needs to submit his Tax Return soon and I am his depend. For Tax Return reasons I would need a SSN, which seems that I lost my "right" for one.

Does anyone know how I could make this work as I applied for a SSN on time, or How to specify my situation on my husband Tax Return without a SSN?

Can I apply for a SSN once I'm notified by the USCIS?

Hi! Unfortunately you should have gone and applied for that SSN as son as you arrived in the US for this very reason. The verification can take a long time. It took 8 weeks for me. You now have to wait for your EAD until you can go and apply again.

 

You guys will either have to wait for that or go get a ITIN prior to filing the taxes... However. You are your husband's spouse. A spouse can't be a dependent. so yeah...there's that also.

Should have applied for SSN 10 days after coming into the country but that's water under the bridge now. 

 

Wait until you get your EAD (or GC whichever comes first) and apply for your SSN. 

 

Husband can file for extension on taxes until October if you don't have a SSN by April 18. (If he owes any taxes will still have to start paying those).

There are some options for the tax filing if you wanna go another route..

I would do as advised by @milimelo unless he absolutely has to file for some other reason.
