Well, there you go :) You had valid documents from the ID category. If they run the NOA1 against the federal database it WILL come back lawfully present. It's either the other categories of documents OR specific rules state rules that trip ppl up (when it's not the staff). As an example, a friend of mine on here in Illinois, the NOA1 is not an accepted document specifically. Had they not had this state law... the federal check would still come back lawfully present.

As long as they will agree to run your documents against the federal SAVE (Make sure your information is entered on your application exactly as it is on your other documents) it will come back as lawfully present. I also brought my marriage certificate cause I wanted the license in my married name. In Texas they gave me one year from i-94 expiration. I've seen some state give 6 months. Eventually you will have to have it renewed anyways ofc.

what drivers license office did you go to? I went to garland and wasn't very successful

Another girl on here also had problems. I was staying south of Dallas then,  so I went to the one in Waxahachie, but they were sceptical as well. It's a bit of a drive if you don't live there too! lol

I'll be going to another one for the renewal since we moved. 

What happened when you went to the Garland one?

What happened when you went to the Garland one? 

they basically said they cant do it without an ead or GC which sucks because I have exams coming up and i cant take them without an ID

Here in California... It's a negative on the NOA1.

If you act quickly you can use your i94 if it hasn't expired... But will you really have an SSN by then?   This is for a regular CA issued drivers license.

 

I then got irate and started shouting "How the hell is it that you provide drivers licenses for illegals but someone that came in correctly is held up by red tape?

 

She said we could go the AB60 route (undocumented person's drivers license) but that you will be stuck with that for 5 years.   Cannot be used for ID/job verification or legal presence purposes.  She then said it would be hell because in some system's u are recorded as undocumented but then because you are going they immigration process...  It would just be a mess.

 

So we walked out and decided to wait a couple more weeks... Her interview is scheduled for Sept 17th I believe.

DE should work like MD, in which the only way you'll most likely be able to obtain a DL is with an EAD, a SSN, and some mail with your new address on it (preferably something official like a bank statement or from a government agency). If you attempt to get a DL on your I-94, it will expire on the same day the I-94 does. Once you have your three things above (and also check out the state's MVA website for further instructions) go in and apply. You'll likely have to complete the written test and road test. MD also required a three hour lecture on drugs/alcohol. You usually cannot do it all in the same day, and you should make sure to study up. Otherwise the written and road test is straightforward. The written test is usually a multiple choice thing on a computer screen, and the study booklet in this state at least is now reduced to a glossy magazine for the kiddie's short attention spans! Road test is short, usually conducted with an officer and only lasts about 10-15 minutes, nothing remarkably difficult at all. Car from FiL must have insurance on it and must meet requirements for proper use. The DL you receive after completion will last as long as the EAD. Return about a week or two, once you have the green card, and update it with the MVA. They will issue you a full license with normal expiry date (something like 8 years or so).

Just a correction. My husband got a 10 month license with his NOA1 for AOS and passport in Maryland last month (July 2017). Super easy process when he went to the Annapolis DMV (only because they had a testing appointment for the next day). He laughed and said everyone testing was an immigrant that day including himself.

 

He also completed the entire online class, written test for online class, written drivers test and road test in less than three days. We were in a rush because we had just realized his Australian license was going to expire in 4 days because of Maryland 60 day resident laws. 

 

(We were actually in a car accident the next week when someone else blew through a stop sign and we were so thankful we were aware of the Maryland law and followed it.)

When I went to the DMV with an unexpired i94 (after about 25 days of being in the states because I had to wait to get my SSN), my SSN, and mail proving my address (with the intention of getting a DL valid until my i94 expired) they would not allow me to, even though I had all the documents on the document list, based on the wait time for a road test. Because my country wasn't a part of the reciprocity agreement I had to take the written and road test. The wait time was two months, so it didn't make sense to get my license to have it be valid for a few days. 

 

I waited until I got my EAD to go back with all of my information and try again, and walked out with a "learner's permit." I had been driving for years, the fact that I had a learner's permit made me laugh. I drove on my learner's permit and carried my unexpired Canadian license for two months before taking the road test, which went fine. 

 

The biggest hassle with getting a license is that it's only valid until my current status expires. (Currently it expires next April). With my conditional green card being approved I will have to go back sometime and renew it for the period my green card is valid for. The worst part is constantly having to go back to the DMV, and constantly having to pay to renew it! 

 

On top of that, my husband and I just moved, so we also have to go back to the DMV soon to update the addresses on our licenses and the titles of our vehicles. 

 

They sure know how to not make it easy! Haha

 That seems really silly. My husband from Australia was able to get his drivers license (skipped the permit) immediately in Maryland. We joked that even if he failed his drivers test he would have to drive himself home on his Australian license since her drove himself to the test in the first place.

For those reading this moving to Washington State, according to the Washington State DMV website:

"If you have a valid out-of-state driver's license (or a valid driver's license from British Columbia, Germany, South Korea, or Taiwan), you don't need to pass any kind of driving test—just a vision screening."  http://www.dmv.org/wa-washington/apply-license.php

My Canadian wife from Vancouver BC had no issues when we got her drivers license here in Seattle.  We walked in, she took a vision test, they verified her paperwork, showed her BC drivers license, and received a Washington State drivers license in the mail with-in a few days.

How annoying how each state differs with drivers license reciprocity.
