RFE for income evidence on form i-864

Back In December we submitted our package for my wive's and stepdaughter. We got their fingerprints taken in early January and on the first week of Feb we received an RFE for form I-864. Last year I started working with a new company back in August making 15 dollars an hour with a annual salary of 31,200. We are a household of 4, requiring me to make at least 30,350 something like that. Now on the RFE it says Not enough 2015 incom and no evidence of 31,200 earned by me in 2016. Now my question is, should't it be based on my current income? Not what I made in the past?

Current income counts. Did you send tax transcripts, an employer letter, pay stubs to prove your current income ?

I did send tax transcripts, employee letter and my previous 6 pay stubs. On my tax for 2015 with the previous job I did not make enough to qualify. I am about to file my 2016 to submit with the RFE but If I combine both jobs (my previous and current) I still wound't qualify I started with my current employer in August. It adds up to 21,500 of the required 30,375. Although with my current employer I make 31,200 annually.

Get a new employer letter stating that you have long term employment, date employed, nature of job etc and the

2016 tax transcript, all pay stubs again, make sure you entered all amounts correctly on the form and submit a
short letter explaining your income. Six months into the new job should be sufficient.

We literally JUST had some rfe's in the November thread... make sure that the number you wrote on 19a-19c match the AGI (line 22 on 1040) for the returns you sent along. Other than that send along all the evidence you can to prove the current income as mentioned by @Ebunoluwa

 

The current income however should be what you expect to make as gross income... (not AGI).

On my 2015 tax filing I reported 4500 of income. From January 2015 to approximately September 2015 I was finishing up on college. On Novenber 2015 I started working therefore I could only report very little on 2015. Now on my 2016 tax return it would total 21,5000. Since I switched company's on August 2016. Now my current Salary is over the required poverty line. But wont be able to show in on my tax until 2017.

 

Should I have any problem If I send the 2016 tax return with supporting evidence(paystubs,employment letter, ect) that In fact I make 31,200 annually. Also should I file joint with my wife?

Sure, file jointly. For most people filing jointly the tax return you get is higher than filing married but separate.
There won't be a problem with the 2016 tax return and as I said include the updated employer letter that shows when you

started and that your position is long term, that your annual income is $31,200 etc., look at a good employer letter sample

and write a short 1/2 page pulling it all together and attach it.

I did and got a second RFE.

My wife recently got her EAD in the mail. We are about to send in our RFE Response. But today we got a letter from USCIS giving us a interview date. Do you think they realized it was a mistake? Just wondering how I got a interview date with an RFE pending.

Your wife got an EAD even though you got an RFE?? Which one came first?

What did your second RFE say? I'm curious because I also got an RFE saying my income wasn't high enough although I'm $14,000 over the requirement. (I'm hoping the RFE was just an automated response because I forgot to send in the accompanying docs from my 2015 tax return) I am sending in 2016 tax return and all docs and proof of income with it next week And really hoping that'll be enough because I can't find anyone to agree to be  a joint sponsor. 

Im wondering if they still aren't satisfied if they'll give me another chance to find a joint sponsor or if they'll just deny him. And if they just deny him does that mean he immediately has to return to Ukraine?

Yes, it is probably just a general RFE because you did not send the other docs,

they always mention income not meeting guidelines and co sponsor when something is missing.
I would send tax transcripts that have everything attached already.
If still incomplete it depends on the IO if he sends another RFE or will deny.
No, he does not have to leave the USA, you can file again as soon as you have the income right and that gives him
protected stay. In between he would be out of status though so file asap.

Hi, 

we ended up getting a joint sponsor. 

I figured they wanted someone with stable income and my husband is a recent graduate  

my second RFE said my sponsor (husband) didn't make enough. So we got a joint sponsor the next day and sent the evidence. Got my EAD approved 10 days after they received my response. 

I don't know if they will give you another chance. I was lucky to even receive 2 rfes to make it right. If he's denied you can reapply or appeal. It's fixable so don't worry too much.  I suggest you call USCIS and ask to talk to a tier 2 officer and explain the situation and ask what you should do. We didn't want to take the risk so we got a joint sponsor.
