I am sorry if this has been answered already, but I am still a little confused.  I have been a LPR since '95 and now want to become a citizen.  I have been divorced, but I am remarried and obviously plan on filing under the 5 year rule.  The current USCIS Document Checklist (M-477) says to only send in proof that my earlier marriage ended, I will submit copies of judgment.  It also says to only submit marriage certificate and other docs when filing under the 3 year rule.  The USCIS N-400 Instructions say to include Evidence of Your Current Legal Marital Status and also Evidence of the Termination of Your Spouse's Prior Marriage(s).  Which one is the correct answer?  Thanks.

I am planning to submit:

N-400

G-1145

G-1450

Copy of Green Card

Copy of Divorce Decree

Anyone?  I would like to submit application tomorrow.  Thanks.

That looks about right. I sent the same except the divorce info as I am still married. Good luck. ??

Joe -

I am in a similar situation - I am sending the copy of the current marriage certificate even if I am applying for the 5 year residency. But I was, as you, confused about what is required and decided to be conservative and send it in.

I figure it will just stay with the file.

  • sending I130 05/16/2007
  • cheque is cashed on 06/11/2007
  • NOA1 in mail 06/13/2007 (who said 13 is badluck )
  • 07/30/2007 After no touches and no other signs we just got an email with the APPROVAL of I130....Thank God !....now what ?

  • 08/07/2007 Case received by NVC and case number assigned :))

  • 08/13/2007 DS3032 and AOS bill were generated
