So I called the ssn office to confirm the order I was doing things I know all offices are different , apparently we cant do name change with the ssn till we have EAD or GC card, my fiancé should have her ssn in a few days .So when we apply for AOS,EAD/AP  ,well take the EAD card ,marriage certificate , our ssn numbers , and request the name change .It seems like every office has its own way of doing things, once we get the EAD should we wait a week or so to make sure its in their system? should we make sure we have the ssn number written down somewhere? ive heard some ppl say they took their ssn card once they showed them the EAD. is the name change with the EAD a simple process?

 

 

I first thought the order of doing tings was to do ssn name change first , then apply for AOS/EAD, but seems not the case at least where I live

You don't need EAD to do a name change on the Social Security card.  Just your marriage certificate.   My wife got her SSN a few days after we got married and we had a certified copy of the marriage license with us.  They would not issue it for us the first time with her new last name.  They sent it to us with her maiden name and after we got it in the mail she immediately went back in and showed the marriage certificate and they sent her a new SSN card with her new name on it.  

 

The AOS/EAD/AP application is independent of the SSN application.  We applied for AOS/AP/EAD also a few days after getting married, weeks before she got her first SSN in the mail.  She went back and get the name changed on the SSN months before getting the AP/EAD card in the mail.   We applied for AOS/EAD/AP with her married name, not maiden name.  We have her GC interview scheduled in March so we've made it this far in the process anyways.  

 

The one problem we had in the process relating to name change was getting her drivers license.  The Michigan SOS office wanted her SSN card in her married name instead of her maiden name before issuing a state ID.  We had to wait for the SSN card to come after that name change before getting her drivers license.  I never really understood the reason for this since if you have a drivers license and bring in a marriage certificate they will change the name on the license based on a marriage certificate.

I applied for my SSN when I arrived as a K1.  

 

When it finally came (7+ weeks later [unrelated spelling of name issue] in my maiden name) I had already filed for AOS, so I went to the office with my marriage certificate and was told they couldn't change the name because the i94 was expired and a different name.  I tried explaining the process and even when the employee called her supervisor over to assist bc she had never dealt with anything immigration related, I was told again they cannot change the name without an EAD or green card.  A third worker came over to correct them and they wound up processing it, but then I got a letter a few days later that I was ineligible.

 

I called and confirmed my number is valid but the name change didn't go through.  I was advised to wait until I have something else that would update the DHS system with my married name.

 

It really does vary office to

office.. but since it's a 2 hour ordeal there, I'll just wait until I have an EAD

I think we were able to do the name change because her i-94 was not expired yet.  We got married within 2 days of her entering the US and applied for the SSN within 10 days.  It took 4 weeks to get her SSN the first time which was around week 6 since she entered the US.  So we still had 40 days or so left on the i-94 when we went back in to change the name on her SSN so we could do it.

We also ran into trouble trying to change my wife's last name (surname) with our marriage certificate. Even a certified copy isn't good enough. You have to have an EAD or GC. I've seen here that some SSA offices are different, though. In any event, we're headed back to the office for a third time next week. (First time was when she was still on her K1 with an unexpired I-94 and the card was issued in her maiden name, second was a with our marriage certificate but was denied.)
